‘Where are your father and mother?’ A young girl, broken by poverty, breaks windows and then breaks down in court

I know that there are people in this world that believe that society has become too soft: too soft on crime, on beggars, on children, on immigrants. They will often look back to the distant past and make specious pronouncements on how there was more respect or deference in the past. It is part and parcel of a lack of empathy for others – perhaps best (or rather worst) expressed by Jacob Rees-Mogg in his hateful comments about the ‘stupidity’ of the victims of the Grenfell Tower disaster.

Before the Liberal reforms of the early twentieth century and the transformative Labour government of 1945 this country treated its poorest with callous unconcern. This indifference to the suffering of the poor was extended to the mentally ill, the sick poor, elderly, and orphaned children. If you weren’t wealthy you simply didn’t matter in the eyes of the elites that ran the country.

I think we can see this in the treatment of one young teenage girl in east London in 1865.

Priscilla Herman was an inmate of the Bethnal Green workhouse. She was under 16 years of age and in November she was brought before the magistrate at Worship Street Police court charged with criminal damage.

The court heard that Priscilla, described as ‘placid’ but displaying ‘features indicative of aught but abandoned and vicious conduct’, had smashed five panes of glass and verbally abused a female overlooker.

That was Ann Summers, who testified that when she’d asked her to do some cleaning work Priscilla had refused and threatened her. Summers was old and the girl had threatened, she said, ‘to beat my _______ old head in’.

The magistrate asked the overlooker why she hadn’t found Priscilla work as a domestic servant outside of the workhouse. She’d tried, Summers explained, but she kept getting dismissed.

‘A great many of the girls turn out bad after leaving us; the language of this one is most shameful and disgusting’.

The police constable that had escorted Priscilla to court agreed that her language was ‘dreadful’. He added that she’d admitted braking the windows but no one knew why she did it.

I doubt anyone really cared why she did it, they simply wanted to punish her for doing so. The magistrate did ask her some questions however:

‘Why did you leave your last place, girl?’

No answer.

‘Did you do wrong?’

No answer.

‘Where are your father and mother?’

At this Priscilla broke down in the dock and started sobbing.

‘I haven’t any’, she cried.

She admitted behaving badly at her last job and promised to do better and ‘be a good girl’ if she were given another chance.

As an orphan under 16 I would hope we would give Priscilla a chance today although given the large numbers of teenagers sleeping rough on our streets I’m not confident that our society would do much better by her.  However, I doubt even  the most heartless of Rees-Mogg’s chums would do as the magistrate here did, and send Priscilla to prison for three weeks, effectively minimalizing any chance of her finding an honest living outside of the ‘house in the near future.

She was led away, still sobbing he eyes out, her future looking bleak as winter approached.

The democratic process under stress: riots at the Middlesex Election of 1852

With a new prime minister about to be announced this morning thoughts turn to a possible General Election. British politics is going through a tumultuous time and it was interesting to hear the new leader of the Liberal Democrats describe the Conservatives and Labour as the ‘two old parties’ when the Liberals are just as ancient and established as the Tories. They used to be the radical party of British politics, a tag they still like to revive when it suits them (as it does today with their opposition to Brexit).

In the mid 1800s parliament was made up of Conservatives (Tories) and the Whigs; the parties that had dominated politics for a century. But within the Whigs there was a splinter of MPs who described themselves as ‘Radicals’. They were dedicated to extending the franchise to include the working classes (who were largely excluded from the vote until the 1860s) and had been agitators against the hated Corn Laws (which kept food prices high for the poorest).

At the general election in 1852 the Radicals stood candidates against the Whigs and the Tories in the two seats that served the London constituency of Middlesex.  Middlesex had been a hotbed of radical politics from at least the late 1600s. The most famous radical MP for Middlesex was probably John Wilkes, and widespread rioting accompanied his election in 1768. Wilkes was a fierce opponent of the government of the day and had to flee to Paris to avoid prosecution for libel and debt. When he returned and stood for parliament he was elected but then promptly imprisoned in the King’s Bench prison. His supporters went on the rampage. Wilkes was a populist with great appeal but deep down he was also a cynical self-serving politician who would later order troops to fire on the Gordon Rioters as he was, by then, one of the City’s magistrates.

In 1852 there were more riots in Middlesex as supporters of the Radical candidate Ralph Bernal Osborne (below right) clashed with those of John Spencer-Churchill (the Marquis of Blandford) who stood for the Tories. An effigy of the Marquis was carried through the streets along with a stuffed fox and a pole with the label ‘a Derby puppet’ attached to it. Lord Derby had become PM in February 1852 following the fall of Lord Russell’s Whig ministry. It was a minority government and it too collapsed in December that year. The riots resulted in a series of arrests and led to three men appearing before Mr Paynter at Hammersmith Police court. Thomas Hall (25) was a sweep; Edward Hewett (33) and William Cook (19) were labourers, so all were working class. After the poll had closed disturbances had erupted at Hammersmith and the police who were there to keep order were attacked. Some of the police were in plain clothes, watching the crowd, and Hall was seen parading with the stuffed fox. PC John Jones (210T) stated that he was assaulted by Hall and as he tried to arrest him a ‘mob’ closed in on him.

PC Petit (194T) went to help and was thrown to ground by Hall. The prisoner then kicked him in the face, bruising his chin. The other two defendants joined in the fracas. PC John Searle (69T) was threatened by Cook who carried a large stick, which had been used to carry a flag, but was now simply a weapon. The police had taken the men into custody after a struggle and at the station it the men had bragged that any fine they got would be paid by the candidate they’d supported, Ralph Osborne.

Gangs of ‘roughs’ were a feature of election campaigns in the period just as they had been in the eighteenth century. Intimidation was common in elections – there were no secret ballots until 1872 so everyone knew who you voted for. The magistrate established that none of the trio were voters and the police said that all of the were known ruffians who’d appeared for assault before. Perhaps they were hired by the radicals, although they would have denied this. Politics was a dirty business in the 1800s, although one wonders whether it is much better today.  Even if Osborne had agreed to pay any fines it didn’t help the men. Mr Paynter told them their behavior was ‘disgraceful’ and said they had ‘interfered with the freedom of the election’, by preventing voters for going to the hustings.  He sentenced Cook to a month in gaol and the others to three weeks each.

After sentencing Cook claimed that he been employed to cause trouble by Dr Simpson and Hall said he was bring paid by a man named Rainbow. It neither of them any good as they were all led away and to be locked up.

The election returned the two incumbent MPs, Osborne for the Radicals and Robert Grosvenor for the Whigs. John Spencer-Churchill (the grandfather of Winston) came a narrow third. He entered Parliament in 1857 when the death of his father meant that he inherited the title of the duke of Marlborough. There were only 14, 610 registered voters in Middlesex in in 1852, returning two MPs. Only about half of them turned out to vote. Now the former Middlesex seat has been broken up into 8 separate seats in London, from Uxbridge to Hornsey.

If the voting system of the 1850s seems undemocratic to modern eyes then perhaps we should note that our next Prime Minster has just been elected by a tiny handful of the electorate, roughly 180,000 people out of 47,000,000 (or less than 1%).

‘A fever amongst people living under the mockery of a poor-law which recognizes no right to relief in destitution’: reflections on the Irish Potato Famine from 1846

Today is St Patrick’s Day and there will be drinking galore in Dublin, London and Boston and throughout the Irish diaspora. The island of Ireland is small, just 32, 500 square miles, and today it is home to around 6.5m people, but it bats above its average in terms of political importance and influence. This is due in no small part to its strategic significance, situated as it is between continental Europe, Britain and the Atlantic, and also of course, because of its long and troubled history. It is not for nothing that the Brexit wrangling in recent months has focused so much on the so-called ‘Irish backstop’; the determination not to recreate a hard border between Eire (the Irish Republic) and the six counties of Northern Ireland.

The Irish influence is widespread however, because of the waves of Irish emigration from the ‘emerald isle’ that took place, for the most part at least, in the nineteenth century. Millions of Irish men and women left their homes to travel in search of food, shelter and work – a better life – in the wake of famine, persecution, and religious intolerance.

Many went to their nearest neighbours, settling in England and Scotland (in London, Liverpool and Glasgow in particular) while many others traveled to the United States (especially New York and Boston). They took their culture with them, hence the St Patrick’s Day parades in US cities today (as above from Boston in the 1870s).

The famine began in September 1845 so by the winter and spring of 1846 it effects could be felt throughout Ireland and the British Isles. England had always had a large Irish immigrant population and they were generally regarded as second-class cousins at best and dangerous Catholic troublemakers at worst. Most of all perhaps the Irish were generally poor and considered to be ‘feckless’ ‘work-shy’ and a burden on the rates. When the numbers of the existing populations were swelled by tens of thousands of new migrants in the mid 1840s antagonisms were heightened.

The Police courts of the English capital were often visited by members of the Irish community, who gravitated to the poorer areas around St Giles, Covent Garden, Whitechapel and Southwark. The Irish had a reputation for hard drinking and ‘fair fights’ (when they were drunk). Brawls in pub spilled over into the streets and there altercations with the police were inevitable.  So arrests would be made for drunken and disorderly behaviour, refusing to quit licensed premises, and assaults on the constabulary. Many Irish ended up in the workhouse or as vagrants and beggars and this could also lead to an appearance before a magistrate.

The situation in Ireland was caused by the failure of the potato crop but exacerbated by the actions of the English landowners, poor law authorities  and government that failed to help the people affected. This was hotly debated in Parliament (just as today’s MPs debate Brexit and the ‘backstop’). Discussions turned around debates between those seeking trade tariffs for imported corn and those opposed to them. Peel wanted to repeal the Corn Laws but this split the Tory party (rather like Brexit has) meanwhile Irish people were literally starving to death. This is a flavor of the debate as reported in the Daily News on the day following St Patrick’s Day 1846:

This measure is an impressive commentary on the time occupied by the Protectionists [those that wanted to keep tariffs] in their long protests. It is fever against which Parliament has to provide. An infliction of fever so national, that Government must interpose to prevent the dying and dead from making the Green Isle a very Golgotha.

It is fever induced by starvation; and hastening on, with giant strides, while week after week is wasted in describing and deprecating the horrors of a superabundant influx of food from foreign countries. Moreover it is a fever amongst people living under the mockery of a poor-law which recognizes no right to relief in destitution’.

Peel’s early attempt to import American corn in secret failed because the quality of the grain was so poor that it was virtually inedible, causing widespread digestive problems so it became known derogatively as ‘Peel’s brimstone’.    At least 800,000 Irish men, women and children died as a direct result of the famine and the failure of the British government to support them, the figure is probably closer to 1-1.5m. A further million (at least) emigrated. If you ever wondered why anti-English feeling remains prevalent at all in the Ireland and amongst Irish communities elsewhere perhaps a reflection on the events of 1845-49 would be instructive.

And that is without considering the actions of the early modern rules of England, the atrocities committed by Oliver Cromwell’s troops, the long battle over Home Rule in the late 1800s, the brutal repression following the Easter Rising in 1916, the ‘black and tans’, ‘Bloody Sunday’, Diplock courts and all the other measures used to govern the northern counties in the Troubles, and of course decades of jokes at their expense.

A Victorian tale to bring a gleam to Mr Duncan Smith’s eyes

The Victorians – and especially those who signed up to the Mendicity Society – had a real hatred of imposture when it came to poverty. The society was determined to root out and expose (and thence to punish) anyone who pretended to be in need of poor relief or charity when they were fit and able to work. We seem to have inherited this distrust of the poor and now frame those we would like to see exposed as ‘benefit scroungers’.

It is fairly common for highly paid, privately educated, and well-connected, privileged members of Parliament to condemn those that claim they cant survive on the little the state provides.  In these hard times there has also been a focus on denying benefits to the disabled, by reinterpreting what it means to be ‘unfit to work’. Withholding benefits or making the hoops that the impoverished need to jump through to get them more complicated or time consuming is another, well practiced, tactic of modern ‘caring’, Conservative Britain.

I think Mrs May, Jeremy Hunt, Amber Rudd, Ester McVey and (especially) Iain Duncan Smith would have relished living the 1800s. Workhouses, ‘less eligibility’ and mendicity officers would have been right up their street (although they may have struggled with this county’s open doors policy on immigration – at least until the end of the century that is).

They would have liked Mr Turner, who gave evidence at Clerkenwell Police court in March 1866. He was there to investigate Johanna (or Ellen) Shields who had been brought up by the curate of St George’s, Queen Square, for begging at his door. The curate (presumably a  ‘good Christian’) had found Johanna knocking on his door asking for money as her husband was sick and out of work and she had six children to feed.

He asked her name and where she lived. Johanna gave a false name (Ellen Thomas) and an address in Little Ormond Yard, in Bloomsbury. He didn’t believe her and to confirm his suspicions he donned his hat and said he’d accompany her home to see for himself. This unnerved Johanna who tried to put him off, saying she would go and get her certificate to prove she was registered in the parish (and so entitled to relief). Instead the curate summoned a constable and had her arrested.

In court at Clerkenwell Mr Barker (the magistrate) was told (by the curate, whose name is never revealed) that Johanna had changed her story when he’d said he’d go with her, which led him to involving the police. The woman now said she lived in Church Street, St Giles, had six children (one of whom was blind) and a sick husband. When he subsequently visited her address he found her husband, and three children, none of whom was blind. He also testified that she had asked his fellow rector at St George’s for help and he’d refused also. He said he was ‘determined to give all imposters into the custody of the police’.

So what was Mr Barker to do with Johanna? She denied the charge but the evidence against came from a respectable source. Moreover the justice expected she’d done it before, and so had ‘form’. She was being treated as if she was a criminal when her only ‘crime’ was being poor and asking for help.

This is where Mr Turner from the Mendicity Society came in. He was tasked with discovering whether she had a history of ‘shamming’ so the bench could decide what punishment (if any) to hand down. This would take a week and Mr Barker decided that regardless of the outcome Johanna would spend the next seven days locked up on remand. The gaoler escorted her back to the cells to be transferred to the Clerkenwell house of detention where she would subsist on bread and water and pick oakum with all the other ‘offenders’.

Does the lack of the vote excuse you from obeying the law?

My method of research for this blog is quite simple. I use today’s date to search back through the newspaper records for a police court hearing with a corresponding date. I thought I might look for a day in June where there was a previous general election given the turmoil of the last few weeks, but there were only two elections in June in the 1800s  (1807 and 1826) both a little too early for the reportage of the Police Courts. So instead I’ve opted for 1859 when the election was held just a few weeks earlier, on 31 May.

That election was won by the Liberal Party and returned Lord Palmerston – he of gunboats fame – as Prime Minister. Palmerston won a significant majority of 59; a figure either Mrs May or Mr Corbyn would have been delighted with on Thursday. However it represented a decline for the Liberals (or Whigs as they were then) from the previous ballot in 1857 when their lead was 100 seats.

This political cartoon refers to Lord Derby’s comment that Disraeli was taking a ‘leap in the dark’ when he sponsored the second Reform Act – which he considered an astute political move. By using popular support for reform to introduce a Bill extending the vote to urban working-class electors, he believed the Tories would stand to gain in subsequent elections.

Perhaps the writing was on the wall because in 1865 the Tories got back in. This was the last general election under the system introduced after the Great Reform Act of 1832, a new reform act in 1867 extended the suffrage (see cartoon reference above) to include many more people and arguably set in motion the move towards the one-person-one-vote system we have in place today. In took the reforms of 1884, 1918 and 1928 to finally do that however.

I doubt any of this concerned Charles Webb in the weeks after the 1859 general election. As a ‘ruffianly looking, middle-aged’ man dressed as a ‘builder’s labourer’, Webb almost certainly did not have the right to exercise his vote whether he wanted to or not. Like most of the poorer class in Victorian society he was unenfranchised, not being considered fit to vote as he did not own property.

We can speculate as to whether this bothered him or not, or indeed whether this lack of a political voice in some way disconnected him from a sense of social belonging. Does a person who has no political rights in a society therefore have no social responsibilities? If you are not part of the mechanism of making laws then can you perhaps be excused for not obeying them?

These are philosophical questions and again I doubt they crossed Webb’s mind as he watched a procession of charity school children march down Cheapside towards St Paul’s Cathedral. Webb was seen by a policeman, PC Legg, who observed him walk into Post Office Yard with another man. He watched as Webb took a purse out of his pocket, extracted a few silver coins (which he gave to the other man) then threw the purse away. The implication was that Webb had stolen the purse (with the aid of his accomplice) and was disposing of the evidence. He moved in and arrested Webb but the other man got away.

At the police station Webb refused to give his address and denied all knowledge of the purse. When the case came before the magistrate at Mansion House, (which was the Lord Mayor, as the City’s chief lawman), Webb explained why:

‘Well of course I did, but I never saw that purse before and I never touched it’. He then aimed a verbal swipe at the policeman: ‘Ain’t you paid for not telling the truth?’

The clearly frustrated copper then told the Lord Mayor that he had searched the prisoner and found that he has specially adapted his coat for picking pockets, an accusation that Webb vehemently denied.

‘My Lord’ began PC Legg, ‘he shoves his hands through his pockets which are open at the bottom, and work in that way’, demonstrating to the court with the accused’s coat.

‘Why what do you mean by that?’ responded Webb, ‘D’ye mean to say I’m a thief? I am as honest as you are, and works hard for my living. Can’t yer see that them ere pockets is worn away at the bottom?’, he finished, prompting laughter in the courtroom.

When the policeman insisted his version of events was correct (as it undoubtedly was) Webb returned to his theme of accusing the officer of lying. ‘Yes I dare say you’ll say so; but you’ll say anything , cos of how your’e paid for it’

This was probably an opinion shared by many of London’s criminal fraternity who had little love of the New Police and saw them as an extension of the old semi-professional watch, their-takers and informers of the previous century. Magistrates generally took the word of a policeman over that of a working-class man, especially if he looked (as Webb did) like a ‘ruffianly’ individual.

The alleged pickpocket was remanded in custody while the owner of the purse, or more information or evidence, was sought. We don’t know what happened to him after that, but I would expect he spent some time off the streets at society’s expense.
