‘The weakness of the dangerous classes’: attitudes to poverty are at the heart of my teaching this term

This week I will begin teaching my third year module at Northampton which focuses on the Whitechapel Murders and East End society in the 1880s. 

It is going to be different this year: with a full national lockdown in place all of my classes will be remote, online. The way we do this at Northampton University is to host online teaching sessions – live, not recorded (although there is always plenty of pre-recorded content for students to access before and after sessions). So I will be in my ‘virtual classroom’ with my normal seminar group, who will all be tuning in from their homes.

It isn’t ideal, it makes discussion harder, but not impossible. There are the inevitable tech problems, and issues with WiFI and simply having a suitable space to study. I’m lucky, I have a home office and a decent chair and desk; some of my students are using the kitchen table in their parental home, with parents trying to use the internet to work, while their younger siblings are home schooled. 

But this is a national (an international) emergency and needs must. As Tony Soprano would say, ‘what a ya gonna do?’ 

This week we will start by looking at the East End through the maps of Charles Booth, who mapped poverty in the capital in the 1880s and 1890s. He famously colour coded individual streets according to their levels of wealth or deprivation: black or dark blue for the ‘worst’ parts, red or yellow for the ‘best’. Much of Whitechapel, Stepney, and Bethnal Green was black or blue. There were red streets – signifying commercial or middle class relative affluence – but these tended to be along the main thoroughfares (like Commercial Road/Street or the High Street). The very heart of the ‘abyss’ (as the American writer jack London later termed it) was very dark and here poverty was endemic. 

Charles Booth undertook his investigation into poverty as a result of what he thought were spurious claims, by the socialist leader Henry Hyndman, that poverty was rife in the capital. In fact he discovered the situation was much worse than even Hyndman had alleged. 

Alongside Booth’s maps my students will study contemporary accounts of poverty and the very many views of the ‘the poor’ expressed by (mostly) middle-class ‘well-to-do’ (to borrow a phrase from Booth) commentators. 

These are revealing because they show us what some middle class people felt about the inhabitants of the East End; it reveals their prejudices, their fears, and how these all came together to shape their thoughts about what could be done about poverty. For example, one report – in the Pall Mall Gazette from January 1888 – of an interview with the Rev. G. S. Reaney is illuminating. Reaney had run the Stepney Congregational Church in the East End for six years by 1888, and was leaving the church for pastures new.  He was both ‘hopeful and hopeless’ about the people he was leaving behind. 

One section of the populace, the native Londoners of the East End, he described as ‘a hopeless class’. He had no idea how they managed to survive the poverty that engulfed them. ‘I imagine they eat a great deal less than we think necessary’, he told the Gazette as he continued packing up his effects to move. ‘I think they occupy very little house room’ and ‘by constant flitting [i.e. moving at night when they were in rent arrears] they escape a good deal of rent’. 

‘They have so little character’, he continued, and were ‘the most drunken and dissolute class of people’. In fact, ‘were it not for their physical and mental feebleness they would form a dangerous class’. 

This gets to the heart of one of the themes I explore with my students: the threat posed by endemic poverty in the late nineteenth century, as seen by the wealthy and elite. Should a state intervene to help these people out of poverty, help give them the ability to support themselves, educate them, pay they better? Or was it hopeless to even try? Would the provision of state support undermine their independence, and help create a dependence culture? 

These continue to be questions we ask today. 

The Rev. Reaney – a Christian man we must assume – suggested that while the ‘hopeless class’ of the East End was possibly beyond saving we might take away their children (following the example of the ‘splendid’ Dr Barnado) and provide them with an education, preferably a long way from the slums of the East End.

Reaney, not surprisingly, had more faith in religion to change society than in politics. Socialism was on everyone’s lips in the 1880s, Marx was in London and the waves of central European immigrants that arrived in the East End brought radical political beliefs with them. These are also things we discuss in the module. 

Perhaps this year, with everyone suffering in so many ways under this pandemic, the struggles of ordinary people in the 1880s will chime more loudly than they normally would. Hopefully, our discussions and debates, albeit fractured by the difficulties of the online platform, will be even more focused and interesting than they usually are.

The Salvation Army refuses to a leave a sick woman in peace

I’m sure we have all had to put up with annoying disturbances at some point in our lives; last year an inconsiderate neighbour chose to party hard until the wee hours as she celebrated her 40th birthday. At about 4 in the morning I was obliged to ask her guests (she had retired to bed) to turn the music off.

I might have expected it from a student house but not a group of middle aged professionals.

If you live in a big city (like London or Paris, or New York) you are likely to be disturbed by the sound of traffic, railways, the sirens of emergency vehicles, and the refuse collectors. These are the normal everyday sounds of urban living however, and we get used to them or accept them as necessary. It is quite different then if someone sets up a band outside your house and plays music incessantly for hours on end.

This was the scenario that brought a vet to seek help from Mr Shiel at Westminster Police court in June 1889.

The vet (described only as a ‘gentleman’, his name not being recorded in the newspaper report) lived in Turk’s Row, Chelsea where he ran ‘an infirmary for horses and dogs’. He told the magistrate that a ‘band of Salvationists’ (meaning the Salvation Army) had congregated outside his property on several occasions recently to perform.

‘There were’, he explained, ‘at least 20 persons singing to a tambourine accompaniment’ and he had called the police after they refused to stop. A policeman had intervened and ‘begged the people to go further off’ but they refused. Instead they just continued making more of their ‘hideous’ noise than they had previously.

The poor vet described how he had told the group’s leader that his wife was ‘lying dangerously ill’ having had complications in her pregnancy. He just wanted her to be able to rest but the officer in charge of the Salvation Army band refused to believe him, and called him a liar.

He asked for a summons to bring the ‘Army’ to court.

Mr Sheil was sympathetic but not very helpful. Couldn’t the police have done more, he asked? ‘They have no power’, the vet replied, or at least ‘they don’t like to interfere’. Had an (often Italian) organ grinder stood opposite his house the police would have happily taken them away, but not, it seems, the men and women of the ‘Sally Army’, however disruptive they were being.

The magistrate would not grant a summons and instead suggested the applicant visit the ‘headquarters of this so-called Salvation Army, and see, in the name of religion, they will continue to disturb a person who is ill’. In other words, challenge their Christian principles and beliefs rather than apply the same rules to them as would have applied to itinerate street musicians.

If it seems hypercritical to us it certainly did to the vet. He left court muttering that ‘he did not see why he should not have a summons, and that the he considered the law ought to protect him’.

It is very hard not to agree with him. Once again it is a case of one rule for some, and another for others.

Today of course the Salvation Army is a well respected charity organization with branches all over the world; in the late 1880s it was an embryonic and divisive group which found itself in court quite frequently on charges of disturbing the peace or obstructing the streets. How times change eh?

Richard Thursgill and his family were awakened by someone ringing violently on their doorbell.  It was about a quarter past one in then morning of the 18 September 1878 and, in that respectable part of Ludgate Hill alarms like this usually meant one thing: fire! Despite being ill the whole family rose from their beds and rushed downstairs.

There was no fire however, and no one to be seen in the street outside either. Then, around five minutes later PC Martin of the City force appeared at the door with a young man. He’d caught him hiding near by after watching him ringing on the bell pull. The pull itself was almost wrenched clean off, so violent had the man’s actions been. The PC wanted to see if Mr Thursgill wanted to press charges.

He did and so the case ended up before Sir Andrew Lusk at the Guildhall Police court. There the young man gave his name as Arthur Stapleton, a solicitor of 62 Bishopsgate Street-without. He denied the charge and his lawyer assured the magistrate that his client was a respectable young law graduate and not the sort of person to do such a thing.

Really, the magistrate asked? In his experience this sort of ‘abominable’ behavior – ringing people’s doorbells and worrying them into thinking a fire had broken out – was exactlythe sort of thing ‘young solicitors and students did for a “lark”.

He had no doubt Stapleton was ‘respectable’ (and did not need him to produce the character witnesses he promised to prove it), but the only question he was concerned with was identification. Could PC Martin be sure that it was this person that had caused the annoyance?

Quite sure the policeman replied, there was no one else in the vicinity at that time and he’d seen him do it. In that case Sir Andrew said, he had no choice. For his ‘most mischievous piece of fun’ young Stapleton would have to pay the princely sum of 20s. He would have charged him less had been less ‘respectable’, merely 10s, but under the circumstances he could well afford 20s.

‘Two fine candidates for the Reformatory’: a pair of ‘street arabs’ are sent to sea

As you may know if you are a regular visitor to this blog space, I teach a module on the history of crime at the University of Northampton. It covers the period 1700-1900 and looks at a variety of topics including different types of offending (from petty theft to murder), the evolution of the court system, development of policing, and the changing nature of punishment (from hanging to the prison). We also explore a number of themes – such as gender, class, continuity and change, and youth.

This week’s topic is youth crime and the suggestion that in some respects the Victorian’s ‘invented’ juvenile delinquency. Arguably ‘Victorian’ is incorrect but there is a persuasive argument that it was in the nineteenth century that commentators really focused their attention on youth crime and that it was then that the word ‘delinquent’ emerged.  The 1815 report of the ‘committee for investigating the alarming increase in juvenile delinquency in the metropolis’ followed its research into the state of youth crime in London.

In the post war period the fear of crime had risen, as it is always had at the end of Britain’s major European conflicts. Returning soldiers always occasioned a heightened tension around criminality and the tense political period after Waterloo lasted for several years. The creation of the Metropolitan Police (which some early historians attributed, in part, to this tension) meant that there was a more regularized police presence on the capital’s streets, and this directly impacted juveniles.

The Committee had focused on youth because many – believing in the reality of a ‘criminal class’ – felt the obvious thing to do was to nip offending in the bud by making efforts to reform young criminals to prevent them becoming older, more dangerous ones. The police, under pressure to justify the rates spent on them, focused on easy targets to boost arrest figures, and these were often the ‘urchins’ that ‘infested’ the city’s streets.

Charles Nye (14) and William Pincombe (13) were just such a pair of delinquents and in January 1878 they were set in the dock at Clerkenwell Police court charged with theft. They were accused of stealing sixpence from a five-year-old boy, simply named as ‘Hunt’.

The thieves were already known offenders and were under police surveillance. Tow detectives from N Division (Vincent and Armstrong) had been following them at a distance for an hour and a half, watching carefully as they approached, stopped, and chatted to several children. They stopped to chat in a friendly way to the little boy called Hunt then suddenly snatched the bag he was holding and ran away. The police set off after them.

The pair were soon caught but detective Armstrong saw Pincombe discard a sixpence as he fled, trying not to be caught with any evidence. In court the police told Mr Hosack that the lads were suspected of committing a string of robberies and had previously been birched and sent to prison for six weeks for other crimes they’d been convicted of. On this occasion the magistrate was loath to send them to gaol, saying they ‘were too young to undergo a long term of imprisonment’.

Instead he was determined that they should go to a reformatory where they might stand some small chance of being rehabilitated. The Reformatory Movement, led by Mary Carpenter, had flourished from mid century and was founded on the principle that juveniles like Charles and William were better suited to an environment where they could learn some useful skills, alongside discipline and a sense of religious morality, to keep them out of trouble in the future, rather than being dumped into an adult prison where they would simply learn to be ‘better’ thieves.

The court clerk made some enquires and later that day Mr Wills, an Industrial Schools officer appeared in court to say that there were some vacancies on the Cornwall Reformatory Training ship. Happy with this option, Mr Hosack sentenced each lad to 14 days hard labour in prison; thereafter they were to be sent to the Cornwall for two years. Magistrates handing down a reformatory sentence had to include a period of hard labour, to soften up defendants and remind them that they were being given a chance at reform. Carpenter had argued against sending children to prison but society demanded that  they were punished, and so punished they would be.

December 1888: Whitechapel is quiet again,but ‘Jack’ is still at large.

Today finds me, weather permitting, stumping around Whitechapel with my third year undergraduates. This is an annual occurrence for me; in the past 12 years I’ve only missed one year of taking students around the area to visit the sites of the ‘Ripper’ murders and the associated places of interest.

This year my route has again been carefully worked out to take in as many places that might prove interesting (from Flower & Dean Street, to Wilton’s Music Hall, to the Pinchin Street arches, and back up to Mitre Square and then Christ’s Church, Spitalfields). It will take us the best part of four hours with stops for lunch and refreshments. At the end of it I hope they will have learned something as well as getting slightly fitter!

130 years ago the shadow of the Ripper still lay across Whitechapel. Following Mary Kelly’s death in early November the case began to lose its interest for the newspapers but no killer had been caught and the police patrols continued. There had been an attempt of the life of one woman (Annie Farmer) on 20 November, just eleven days after Kelly’s murder, and there was another homicide that can be associated with ‘Jack’ on December 20 that year (Rose Mylett), but things were more or less back to ‘normal’ in East London.

On Thursday 13 November 1888 the proprietors of Batey & Company Limited, ginger beer manufacturers, were summoned to appear at Worship Street Police court accused of infringing the factories act. It was alleged that the company had employed 21 young women who were set to work beyond 2 o’clock on Saturday afternoon at the company’s factory in Kingsland Road.

Under the terms of the act they should have been released at 11.30 that morning but the company was hard pressed. There had been, its representative explained, an ‘extra demand for aerated waters, owing to the late summer’. They admitted their culpability and Mr Bushey fined them £21 (£1 for each girl) plus £2 2scosts. It was an expensive day in court for the Bateys and one wonders if an employee had blown the whistle on them or whether a factory inspector had been watching them. Often these prosecutions followed repeated infringements of the law, rather than being isolated incidents.

The paper that day also chose another similar case to remind its readers (who would have come from the same class as the owners of the factory in Kingsland Road) that the laws must be respected. Hannah Bender, who worked as a French polisher, was fined £1 plus 4sfor employing two young women after eight in the evening, against the statute. The Match Girls strike had happened in 1888 and so labour rights were fresh in everyone’s memory, perhaps that was why these cases were prosecuted, or at least highlighted by the Standard.

In June next year my own solution to the Whitechapel murders is due for release. Based on several years of research it is a collaborative effort with an independent researcher, Andy Wise. We hope to offer a new angle on the killings that terrified Londoners in the late 1880s. 

A ‘typical girl’ in the dock at Clerkenwell

In my seminar last week my students and I were discussing forms of property crime in the eighteenth and nineteenth centuries. One of those we focused on was shoplifting, noting its increasing importance in contemporary discourse in the 1700s (as the number of shops in London grew and the emphasis on the display of goods made them more vulnerable to opportunistic thieves).

They were interested to note that women made up a more equal  proportion of defendants at the Old Bailey in shoplifting trials than they did, say, in highway robbery or burglaries.  Indirect thefts, such as shoplifting or pocket-picking, were much more likely to feature females or children than the direct and often violent or dangerous crimes of robbery and housebreaking or burglary.

We also looked at what shoplifters stole and at why female thieves mostly seemed to have filched items that fitted within their social sphere. Thus women took clothes, or linen and lace, lengths of materials, and ribbons. Men, by comparison, stole tools, money, and precious items such as watches. Women did take these as well, but images of female thieves with ribbons and lace tucked under their clothes are more common.

The explanation is straightforward: women took things they could use or easily get rid of. There was a huge market in secondhand clothes and materials into which thieves could ‘invest’ their loot. Suspicions might be raised by a woman walking through town with a bag of working-men’s tools but not by a basket of ribbons.

Mary Ann Stanniel was only 18 when she appeared before Mr D’Eyncourt at Clerkenwell Police court in November 1860 but she had already established an unwanted reputation as a ‘well-known shoplifter’. On this occasion she was charged with taking two samples of silk ribbon belonging to John Skinner a linen draper on the Pentonville Road.

Mary had entered Skinner’s shop with a friend and then engaged the shopkeeper in conversation in a classic distraction technique. They asked him to show them two completely different sorts of product and Skinner was on his guard. He’d been robbed before and spotted the attempted deception.

However, having two young women in his shop, each demanding to see different things at the same time he was hard pushed to keep his eyes on both of them. He called his wife to help and she provided the necessary extra pair of eyes. Soon afterwards she noticed that a piece of blue ribbon was missing. Mrs Skinner came round the counter and took hold of Mary Ann’s hand, turning it over to reveal a roll of ribbon. It wasn’t the blue one she’d lost, but it was theirs so the police were called.

The blue ribbon was missing so when PC Lillycrap (409A) arrived he took Mary Ann to the station and searched her. It seems that her friend had done a runner when Mary Ann had been pinched by the shopkeeper’s wife. No ribbon was found on Ann so the policeman came back to the shop to check again. After a quick search the ribbon was found on the floor, behind some other things, where the defendant had hastily dropped it.

PC Lillycrap told Mr D’Eyncourt that he had arrested Mary Ann before and that she’d been up before the bench at Westminster Police court on similar charges. Mary Ann had some support in court, in the form of a solicitor who urged the magistrate to deal with the matter summarily, saving her a longer spell in prison after a full jury trial. He promised that after she had served whatever time the justice felt was appropriate Mary Ann’s father would ‘take her home and look after her’.

Whether D’Eyncourt believed him or not he did as requested and sent the shoplifter to the house of correction for four months and told her she ‘was fortunate’ she hadn’t got longer. Let’s hope her father kept his promise.

The student who thought he knew the law better than a magistrate

John Williamson was a Law student who lived in Queen’s Road, Bayswater. In November 1874 he entered the Spread Eagle pub  accompanied  by a soldier he’d spent the afternoon drinking with, and demanded to be served.

The publican, Mr Barwell, took one look at Williamson and his companion and decided they were drunk and so refused to serve them. Victorian landlords were wary of serving drunks because they were obliged (under the terms of their licenses) to keep ‘orderly’ houses and overly inebriated customers could be troublesome.

The law student took this refusal badly however, and when he got outside he took out his anger on the landlord by smashing one of his windows before running away. The police were called and Williamson was arrested in Davies Street nearby and taken into custody.  He was then held overnight at a police station before being presented at Marlborough Police Station in the morning charged with being drunk and causing criminal damage to the value of £4.

Williamson, as a student of the law, decided (unwisely it has to be said) to challenge the legal basis for his arrest. He declared the arrest was unlawful because the ‘constable did not see him break the window’. Instead of arresting him and holding him in custody the policeman should have taken his name and address so that Mr Barwell could have applied for a summons.

Mr Newton (the sitting justice at Marlborough Street) told him he was wrong. The constable had acted correctly; the young man was drunk and acting in a disorderly manner. He convicted him of the damage and ordered him to pay for the damage he’d caused. In addition to the £4 for replacing the window he fined him 20s (a not inconsiderable amount) for being found drunk. The magistrate warned him that if he failed to pay either of the sums owing he would go to prison for six weeks.

It was an object lesson in presuming to know more than one’s ‘betters’ and I’m fairly sure the experienced legal professional enjoyed making his point absolutely clear to the precocious young undergraduate. Whether the  lesson was learned is a moot point.

Tough on crime…

When Caroline Wright came before the magistrate at Marlborough Street she pleaded poverty and blamed her actions on ‘distress’. This week I have been looking at the causal factors of property offending in the 18th and 19th centuries with my 2nd year undergraduates at Northampton, as a part of wider module on crime and punishment from 1700-1900.

We have explored contemporary attitudes towards theft and the way that prosecutors and jurors were sometimes prepared to understand theft as a reaction to times of dearth and economic hardship. Simply put there is some evidence that juries were less likely to convict when prices were high and wages (or employment) low. They also seem to have practised ‘pious perjury‘; downgrading the value of goods stolen so as to reduce the maximum sentence a convicted person could receive.

I suspect juries were often more likely to show this discretion than magistrates, and for London justices faced with thousands of petty thieves each year I doubt how much sympathy was on offer – especially after 1830 when the death penalty had been removed from all property offences.

Caroline Wright was, by the account given by a policeman at her hearing, a drunk. Sergeant Miles said she ‘was a confirmed gin drinker’, who was ‘frequently drunk’. On this occasion she had helped herself to a piece of velvet plush from outside a shop at 111 Tottenham Court Road.

The velvet had been displayed with other goods, draped over a chair outside the shop (which shows us that practices have changed somewhat – its is unlikely that such a valuable item would be left outside a store today). But Ann Cumley, the shop woman, was watching Caroline. When she saw her grab the velvet and hide it under her shawl she ran out of the shop to stop her.

A short chase ensued before Ann caught up with the thief. As a policeman came to help Caroline dropped the plush at the shop assistant’s feet. In court she told Mr Bingham the magistrate that she was in desperate distress and that was why she stole the cloth. The justice was not convinced: ‘it was a strange thing to talk of distress driving her to commit a theft, it was more likely the gin she had a propensity for’.

Wright was probably hoping to sell the velvet (a useful material for drapes or cushion covers) but we can have no idea what she wanted the money for. Gin is likely but that might well have been a symptom of her poverty and ‘distress’. Like drug addicts today, stealing might well be to feed a habit but that habit might equally have been a product of a deeper personal descent into poverty, mental illness and desperation.

Mr Bingham sent her to prison for three months at hard labour.
