Kipling published his Barrack-Room Ballads in 1892 which included one of his most famous poems, Tommy. The poem highlights the reality of solders’ situations in late Victorian Britain; eulogised as ‘heroes’ when there were enemies to defeat, and condemned as ‘bar-room brawlers’ when they were cooped up in garrison towns like Aldershot or Colchester. Not that much has changed in the intervening 100 plus years, ‘squaddies’ are still a cause for concern on Saturday nights in Colchester, but every serviceman and woman is deemed a hero at the point they are killed or wounded in action.

Kipling’s poem calls for change and an acceptance that ‘tommy’ was simply an ordinary man called upon to do extraordinary things. Within a quarter of  a century the ranks of Britain’s small professional armed forces were swelled by millions of citizen volunteers and (from 1916) conscript ‘tommies’. This weekend we remember the millions that died in that war and those that have given their lives since, as well as all those that were wounded, both physically and mentally, in conflicts since 1914.

And perhaps here we can point to some improvement in the way in which we look after  our damaged servicemen. Although we still need charities like Help for Heroes to augment government provision we have become much better at rehabilitating the injured. This is especially true in the area of mental health. Before the First World War the notion that soldiers were adversely affected mentally by war was not properly considered even though it must have been evident to some.

It was the work of Dr W. H. R Rivers, a psychiatrist in Craiglockhart Medical Hospital in Scotland during the war that did much to help society understand mental illness in the context of war, even if this treatment was not really adopted at the time.

Today’s tale from the Police Courts doesn’t feature soldiers but it is related to the problem of mental health and its treatment in the 1800s. I’ve chosen 1892 because of the publishing of Kipling’s poem.

A man named Smythe appeared at the West London Police Court to ask for a summons. The request was for a summons to bring the superintendent of a private lunatic asylum to court for unlawfully detaining a prisoner called ‘Carter’.  Mr W. Doveton Smythe explained that Carter had been imprisoned for five years for shooting at a man but, just four months before he was due to be released, he had been transferred to Broadmoor Prison in Berkshire, where criminals deemed to be ‘insane’ were confined.

From Broadmoor he was later taken to a pauper lunatic asylum (presumably being thought no longer to be dangerous) and then, at the request of his mother, he was placed in a private mental asylum. So, this prisoner, who had served his sentence, was now effectively being held against his will in a secure institution and Mr Smythe (whose relationship to the Carters is not made clear) was trying to get him out.

Mr Smythe told the magistrate, Mr Curtis Bennett, that Carter had been examined by an independent specialist  (Dr Flood) and visited by several friends. They all felt that he was ‘perfectly sane’. He wanted a summons against the superintendent for assault, since (as he was sure the magistrate was aware) ‘illegal detention is, technically, an assault’.

Mr Bennett was unconvinced. ‘Friends are really the worst people to form an opinion in such a case’, he told the complainant. ‘Unfortunately that has been the cause of many murders being committed’.

Moreover, this wasn’t the right place to make his request. Removing Carter from the private asylum would not overthrow the original decision to send him to Broadmoor or the pauper asylum. Therefore he advised Mr Smythe to take his complaint to the Lunacy Commissioners instead, and if he got no joy there he suggested the [Chancery] Master in Lunacy instead.

‘There is a remedy for almost every wrong in this country’, he declared, ‘though many people do not seek the right remedy’.

Mr Smythe thanked him and left, meanwhile poor Carter remained locked up in a private asylum.

Whilst today is Hallo’een and this evening we will be inundated with small children flying high on sugar and commercialized excitement this is also the week that poppy sellers really began to make an appearance.  I’m not going to engage in the debate as to whether or not anyone should wear a poppy (or what colour that poppy should be); I believe that men and women have died in wars to preserve our freedoms and the freedom to wear a poppy (or not) is part and parcel of that.

Poppies were first sold in Britain in 1921, the year the Royal British Legion was formed. It sold 9,000,00 of them and raised £106,000 for veterans from the First World War. Last year 40,000,000 were sold worldwide and now the Legion helps veterans from all wars in the 20th and 21st century. The FWW was meant to be the ‘war to end all wars’, sadly it wasn’t.

What struck me about the reportage from the London Police courts for hallo’ween 1870 was a story about six young lads who had been collecting money for veterans, just as the Legion’s poppy sellers do today. The boys (part of a wider group of 36 they said) had approached Sir Robert Carden at the Guildhall just as the court was closing for the day.

A spokesman for the group piped up to say that they were asking for the magistrate’s help as they hadn’t been paid. When asked they said they took a stand in the street and collected money in a box which they then returned to the clerks in ‘the office’. Depending on the amount they raised they were paid between 2s6dand 4sa week. However, when they went to collect their money that day the office was closed and they had gone away empty handed.

It seems they were collecting considerable sums of money from the public. They knew how much because the opening used to remove cash was kept sealed. Nevertheless the boys could feel the weight of the boxes and could see the money being put in them. One lad, who stood outside Bow Church on Cheapside said that he seen a gentleman put in a sovereign and two other men donate half sovereigns. Each box must have amounted to a considerable sum and so for just a few shillings a week the lads were doing great work in drumming up money for the charity.

Sir Richard was sympathetic to their plight but thought that it might just be  a temporary error on the behalf of the clerks to forget to pay these six individuals. He advised them to try once more the next day but to return to see him they remained unpaid. In that case, he said, he would take more formal action against the charity.

So this shows us that the courts were used for more than just crime, they were arenas for negotiation, advice and support. It also reveals that there was some sort of charity to support old soldiers in the late 1800s, perhaps a recognition that the Victorian state (as Kipling later observed) was not doing enough.

No help for heroes at Westminster, just a prison cell

In 1892 Rudyard Kipling published a collection of poems called ‘Barrack Room Ballads’. This included ‘Tommy’ which he’d penned a coupe of years earlier and contrasted the public view of the Victorian soldier in wartime and peace. This is best summed up by this line:

Soldiers – as Kipling’s poem suggested – were to be valued when there was fighting to be done but were considered a nuisance at other times. I grew up watching the annual Festival of Remembrance that honours the dead of two world wars (and subsequent conflicts) but while the British Legion have done much for ex-servicemen and their families it was still deemed necessary to create the Help for Heroes charity in 2007 to support men and women wounded in the course of serving in the armed forces.

We might well ask why such a charity is needed in one of the wealthiest countries in the world, a country which is a founder member of NATO and that has an arms trade that generates billions from the sale of lethal weapons across the globe. Then again we might ask ourselves why over half a million people used food banks in Britain last year, or why the DWP (Department for work and pensions) concluded that in 2016 over 21m Britons were living in ‘relative poverty’.

But back to ‘Tommy Atkins’ and public attitudes in the 1800s. There was no ‘help for heroes’ then, or a British Legion. All the ex-soldier without work could rely on at mid century was his army pension (if he had one) charity, the Poor Law, and his wits. George Hill had no pension because he’d been kicked out of the army for getting drunk and assaulting an officer.

Hill was lucky; if he’d attacked the officer whilst on active service he’d have faced a court martial and the possibility of a firing squad. Instead he’d been released ‘with ignominy’ and no pension and had subsequently found it difficult or impossible to secure gainful employment. As a result Hill sat himself on the streets of London with a painted sign that read:

9th Regiment of foot.

I have served 22 years in the 9thFoot – 20 years in India, and have been in eight general engagements, and am now discharged without a pension’.

Begging was a summary offence and so when PC James Light (128B) discovered him on his beat he asked him to move along and, when this request was ignored, arrested him. The former infantryman was brought before Mr Broderip at Westminster Police court where his previous military indiscretion was revealed. In the eyes of Victorian society Hill was a violent drunk who deserved nothing from a society he had served for 22 years expect condemnation and a prison cell. The magistrate duly obliged and sent him down for three months.

George Hill may well have been a ‘impudent, violent beggar’ and he certainly had previous convictions for vagrancy but today we recognize that ex-servicemen suffer mental as well as physical wounds as a consequence of what they’ve been through. Perhaps Hill’s 22 years in the colours had left him similarly scarred and unable to function as a part of ‘normal’ Victorian society.

He had probably fought at the battles of Mudki and Ferozeshah during the First Anglo-Afghan War and so, like many modern soldiers, had been to Kabul. He would also have been with the colours at the battle of Soprano (right) in the First Anglo-Sikh war. Technically of course he was fighting under the general banner of the East India Company but that matters little, the danger and suffering is the same.
