Another dreadful attack on the police and an echo of PC Culley, the first officer to be killed ‘in the line of duty’.

It was claimed last week (by the Daily Express) that assaults on the police had risen to ‘28 attacks a day on officers in crime epidemic’.1

With recent events in mind it is easy to suggest that our police men and women are at a greater risk of harm than ever before but as one independent fact checking organization has shown, it isn’t really possible to compare rates with those in recent years because reporting criteria has changed.

The reality is that from their very inception, in 1829, members of the public have subjected the police to attacks. It has not become then a dangerous occupation, it always has been. The first officer to die to be killed in the line of duty was PC Robert Culley. He signed up for Peel’s new force in September 1829, joining C Division. On 13 May 1833 he was part of a team sent into break up a demonstration of the National Union of the Working Classes (a group  of radicals demanding parliamentary reform). The gathering at Coldbath Fields in Clerkenwell descended into violence as the police moved in to disperse it and PC Culley was fatal wounded in the affray.

Hundreds of officers have died since Culley, with PC Andrew Harper being the most recent. Many thousands more have been injured and it is unlikely that we would ever have a true figure for this because statistics for common assault are notoriously unreliable. During the first 20-30 years of policing in England the police were deeply unpopular in working class areas. Seen as ‘class traitors’, and busybodies their use to suppress Chartism or demonstrations against the hated Poor Law won them few friends. Nor did their efforts to close down markets or stop street gambling endear them to working-class communities.

While they enjoyed gradual acceptance by the end of the century it would be fair to say that the public still saw the police as a ‘necessary evil’ rather than the ‘lovable bobby’ that 1950s and 60s television dramas like to depict.

In 1883 William Aldis was brought before the magistrate at Thames Police court in the East End of London. Aldis was a costermonger – a small trader who sold goods from a barrow. Costers were always being asked to ‘move along’ by the capital’s police and they resented these attempts to interfere with their traditional way of life. They saw the police as their enemies.

On the 2 August 1883 PC James Simpson (135K) was on duty just after midnight on Salmon’s Lane in Limehouse. He noticed Aldis and a group of ‘roughs’ standing outside the Copenhagen pub. They were drunk and rowdy, and making quite a noise so PC Simpson moved over to tell them to go home.

Aldis saw his opportunity to ‘serve out a policeman’ (as one coster had famously boasted to Henry Mayhew) and punched the officer in the face, blackening his eye, and sending him crashing to the pavement. The other roughs steamed in and rained down blows and kicks on the stricken policeman as he lay helpless on the ground. When they’d finished their work they ran off before help could arrive.

William Aldis was arrested later but it took a while for the case to come to court because PC Simpson was too sick to attend. Even two weeks later he was still unable to appear to give evidence in person. Evidence was obtained however, which satisfied Mr Lushington that the costermonger was to blame for the assault and he sentenced him to six months at hard labour.

So before we carried away in thinking that we have a ‘crime epidemic’ on our hands today and that something different is happening in society it is worth remembering again (as my blog yesterday argued) that violence towards the police and others is nothing new. That may not be very comforting but it is the reality.

‘The water rushed in with such violence’: the flooding of Southwark workhouse

It always seems strange to be looking at the news and seeing scenes of devastation caused by flooding in the summer. The situation at Whaley Bridge in Derbyshire is awful and surely yet another example of how climate change is affecting the planet. But it is August and I associate torrential rain and flooding with the autumn and winter, not the summer.

Clearly I’m no meteorologist and even a casual glance back at the past reveals that sudden downpours and extreme weather is not a new phenomenon (even if the climate emergency we are now facing most certainly is).

In August 1846 three young girls were brought before the magistrate at Southwark Police court to be disciplined for their disobedience. The girls, who are not named in the newspaper report, were all inmates of the Southwark workhouse on Mint Street. Their crime – such as it was – appears to have been a refusal to do the work that was allocated to them by the institution’s porter, who was in court to testify against them.

He explained that on the previous Saturday (the last one in July) there had been a storm that had caused severe flooding in the basement. He had instructed the trio to help carry several beds from the ward to the upper stories of the building. Southwark workhouse was built in 1782 as a three story structure with a new section added in 1844. The ward in the basement was called the ‘probationary ward’ and it housed some of the sick female residents.

The flood was frightening, one inmate told Mr Secker: ‘the water rushed in with such violence, that before she could escape with her child it rose up as high as her waist, and it was only providential that some of them were not drowned’.

The three girls were asked to explain their refusal to carry the beds upstairs. They stated that the beds were simply too heavy for them and ‘above their strength’. Had the porter and workhouse staff allowed the beds to be separated (i.e. taken apart rather than left whole) then they could have managed it and been happy to do it. They added that they were then punished by the porter by being forced to remain in the flooded basement and ‘treated with much rigour’.

We know that workhouses were terrible places often run by cruel overseers who treated the inmates appallingly. Oliver Twist may be a novel but it is not a fantasy. In 1865 a report by the medical journal the Lancet condemned the state of Southwark workhouse stating that it ‘ought to be removed, and one built better adapted to fulfil its duties to the poor and sick of the neighbourhood’. Regardless of this it continued to serve the area until 1920.

‘Pauper bastilles’ like Southwark were designed to be places you did not want to enter. Under the principle of less eligibility’ set out in the 1834 Poor Law Amendment Act going into a workhouse was supposed to be a least resort. The aim was to deter anyone who was able bodied from seeking poor relief. Only the sick and old would ask for help from the parish, everyone else would try to find work, any work, rather than enter the ‘house’.

Mr Secker could see that the three little girls had done nothing wrong, at least not in the eyes of the law. He stopped short of admonishing the cruelty of the porter who had tried to make children carry heavy iron beds up from a flooded basement and then locked them in a dark wet ‘prison’ as a punishment. Instead he simply said that no further punishment was necessary or appropriate and discharged them, presumably back into the ‘care’ of the parish authorities.

A mother’s desperation drives her to steal

The year 1834 was an infamous one in English social policy history. It was in that year that the Poor Law Amendment Act was passed, ushering in a more draconian system of poor relief that split up families and created a stigma around poverty that lasted well into the twentieth century.

The historical arguments around the creation of the New Poor Law in in 1834 have their own long history and so I will limit myself here to the barest of details, readers could seek out the work of Poor Law historians such as Brundage, Digby, Englander, Higgenbotham, and Rose if they want to study this more.

In essence the 1843 act aimed to stop the practice of outdoor relief – where paupers were given top-ups (‘doles’) to supplement low or no wages in order to survive in times of economic hardship. Instead they were all expected to present themselves at a workhouse if they wanted support form the parish. The ‘house’ became a symbol of terror and oppression as anyone entering it effectively lost all control over their life. They were given workhouse clothes, men and women were separated, children taken from parents, and all were set to work in heavy manual labour in return for a very basic subsistence.

Not surprisingly those that found themselves in poverty did everything they could to avoid the workhouse, which was the intention of the act itself. Edmund Chadwick and the other committee members that framed this nasty piece of legislation wanted to ensure that pauperism was prevented by the deterrent nature of the system. The underlying principle was ‘less eligibility’. Workhouse conditions had to be worse than those outside so people were deterred from using them.

The Poor Law commissioners were driven by a desire to reduce the costs of poor relief, which fell on the pockets of the rate paying parishioners. While most people (certainly most middle class rate paying people) in Victorian England would have described themselves as Christians they clearly hadn’t read the sections of the New Testament which deal with poverty.

Mary Ann Stokes was poor. In 1845 she found herself so desperate to feed her two young children and avoid going into a ‘house’ where she’d lose them that she resorted to theft instead. Widowed, but ‘respectable’, Mary Ann had gone from her home in Blackfriars to the open fields at Battersea, south of the river Thames, where several market gardeners grew vegetables for the London markets.

She was found at 2 in the afternoon by police constable Jackson (178V) in land owned by William Carter and he stopped and searched her. Mary Ann had three lettuces, three carrots, and 39 small onions tied up in a large handkerchief and so he arrested her. She admitted the theft but begged for mercy, saying she was hungry and had to feed her children. The policeman took her to court at Wandsworth for the magistrate to decide what to do with her.

The market gardener, Mr Carter, was in court and to his credit he refused to press for a conviction. He could see that Mary Ann was desperate. She stood in the dock, wearing her ‘widow’s weeds’ and clutching her children to her. In court she claimed she’d found the vegetables and hadn’t stolen or picked them. Mr Clive, the sitting magistrate, said he would discharge her, not because he believed her story that she’d found the veg but because it couldn’t be proved that she’d taken it.

It was a pretty heartless decision because in effect he was warning her that next time she might not be so lucky, and be seen stealing. He offered her no help, no charity, no chance to find paid work, nothing but a reprimand. Mary Ann was in this situation because her husband had died, she’d lost the family’s breadwinner and had to care for her children as well as picking up whatever work she might be able to.

This was not an uncommon situation in the Victorian period where poverty blighted the lives of millions. The first real attempt at change came in 1908 when the introduction of Old Age Pensions ushered in the first stage of the Welfare State. We should not however that anyone that had sought help in a workhouse at any point in his or her life was not eligible for an OAP.

The stigma, therefore, continued long into the new century.

A Victorian tale to bring a gleam to Mr Duncan Smith’s eyes

The Victorians – and especially those who signed up to the Mendicity Society – had a real hatred of imposture when it came to poverty. The society was determined to root out and expose (and thence to punish) anyone who pretended to be in need of poor relief or charity when they were fit and able to work. We seem to have inherited this distrust of the poor and now frame those we would like to see exposed as ‘benefit scroungers’.

It is fairly common for highly paid, privately educated, and well-connected, privileged members of Parliament to condemn those that claim they cant survive on the little the state provides.  In these hard times there has also been a focus on denying benefits to the disabled, by reinterpreting what it means to be ‘unfit to work’. Withholding benefits or making the hoops that the impoverished need to jump through to get them more complicated or time consuming is another, well practiced, tactic of modern ‘caring’, Conservative Britain.

I think Mrs May, Jeremy Hunt, Amber Rudd, Ester McVey and (especially) Iain Duncan Smith would have relished living the 1800s. Workhouses, ‘less eligibility’ and mendicity officers would have been right up their street (although they may have struggled with this county’s open doors policy on immigration – at least until the end of the century that is).

They would have liked Mr Turner, who gave evidence at Clerkenwell Police court in March 1866. He was there to investigate Johanna (or Ellen) Shields who had been brought up by the curate of St George’s, Queen Square, for begging at his door. The curate (presumably a  ‘good Christian’) had found Johanna knocking on his door asking for money as her husband was sick and out of work and she had six children to feed.

He asked her name and where she lived. Johanna gave a false name (Ellen Thomas) and an address in Little Ormond Yard, in Bloomsbury. He didn’t believe her and to confirm his suspicions he donned his hat and said he’d accompany her home to see for himself. This unnerved Johanna who tried to put him off, saying she would go and get her certificate to prove she was registered in the parish (and so entitled to relief). Instead the curate summoned a constable and had her arrested.

In court at Clerkenwell Mr Barker (the magistrate) was told (by the curate, whose name is never revealed) that Johanna had changed her story when he’d said he’d go with her, which led him to involving the police. The woman now said she lived in Church Street, St Giles, had six children (one of whom was blind) and a sick husband. When he subsequently visited her address he found her husband, and three children, none of whom was blind. He also testified that she had asked his fellow rector at St George’s for help and he’d refused also. He said he was ‘determined to give all imposters into the custody of the police’.

So what was Mr Barker to do with Johanna? She denied the charge but the evidence against came from a respectable source. Moreover the justice expected she’d done it before, and so had ‘form’. She was being treated as if she was a criminal when her only ‘crime’ was being poor and asking for help.

This is where Mr Turner from the Mendicity Society came in. He was tasked with discovering whether she had a history of ‘shamming’ so the bench could decide what punishment (if any) to hand down. This would take a week and Mr Barker decided that regardless of the outcome Johanna would spend the next seven days locked up on remand. The gaoler escorted her back to the cells to be transferred to the Clerkenwell house of detention where she would subsist on bread and water and pick oakum with all the other ‘offenders’.

No help for the weakest from a society which simply didn’t care

There are so many dreadful stories of poverty and distress in the pages of the nineteenth-century press that it would possible for me to write about that topic every single day. The number of attempted suicides in London in the 1800s reveals the struggle that so many people had with poverty, mental illness and a society that simply provided no proper system of support for those that didn’t ‘win at life’.

For me it is a constant reminder that the greatest achievement of the British state was the creation of the Welfare State in the aftermath of the Second World War. Clement Atlee’s post war government presided over a broken Britain, one battered by war which, while it had emerged victorious, had come perilously close to defeat and invasion by Hitler and fascism. Churchill is rightly credited with pulling us together through that dark period of our history but, for me, it was Atlee’s government that secured the peace by setting in place the foundations for rebuilding society.

In the early 1860s Britain was not at war – we’d had seen off the might of Imperial Russia in the Crimea several years earlier and the Indian Mutiny (or, more properly, war of independence) was a fading memory as well. Great Britain had an empire that covered the globe and our wealth was unsurpassed. Yet despite this our rulers did very little to support the poorest in society or recognize the contribution that others (‘foreigners’) had made to the nation’s success.

The Poor Law of 1834 had been designed to penalize the poor and to deter people from asking for help by effectively locking them up in a workhouse and breaking up their families if they did so. We had no NHS either, there were charities that helped the poorest with medical care but no universal right to free healthcare at the point of need. The understanding of mental illness was still in its infancy, and without private means an individual suffering with any form of mental illness was likely to be thrown into a workhouse or public asylum to be mistreated by doctors and nursing staff that knew very little and cared much less.

Muhomed Ali Khan was a member of the British Empire who felt he was entitled to its support. After 1857 and the failure of the Indian uprising the British state had taken full control of the Indian subcontinent. The British ruled for the benefit of the Queen and the motherland, not for the millions of indigenous Indians that lived there. Khan must have come to England to work, perhaps as a sailor, or soldier in the Queen’s army, or even as an employee of the East India Company.

Whatever the reason in 1862 he was in a parlous state. Destitute and suffering with physical and mental illness he was found at 11.30 in the morning outside the office of the East India Company in Victoria Street by a policeman. When asked what he was doing Khan told PC John Fever (255A) that he ‘had a claim on the government, and had determined to die at the door of those offices’. Fearing the man would make good on his promise PC Fever picked him up and helped him to the nearest workhouse.

Two days later Khan was back outside the EIC offices and had to be dragged back to the care of the workhouse staff. He had nothing to eat in between and was causing ‘annoyance’ by ‘walking about day after day in front of them’. The poor man was embarrassing the company that had profited so much  from the exploitation of India, its people  and its natural wealth. So he was brought before Mr Arnold at Westminster in a case the paper headlined ‘the Troublesome Indian’.

Here we learn that Khan had been ‘troublesome’ before: he had gained entry to the House of Lords and made an attempt on his own life. He had also appeared at Horse Guards during the Queen’s procession to open Parliament and had tried to cut his own throat. On both occasions, the magistrate was told, the poor man was sent to prison but it clearly hadn’t had the effect intended.

Mr Arnold was sympathetic but unable to do anything of real use for Khan. He hadn’t committed  an offence by wandering outside the EIC’s offices so he discharged him from court, but he didn’t help him much either. The man was given a shilling to get some food and sent on his way. It was almost inevitable that he would end up dead in the river or a workhouse infirmary before long and Victorian society, frankly, didn’t care which.

The British Empire and state was built on the backs of the vast majority who did not benefit from it but this was not properly recognized until Atlee and that first Labour administration.  I rather fear that lesson has been lost over the years as we worry about ‘benefit scroungers’ and continue to underfund the NHS and social care. For Mohamed Khan in 1862 we have the unnamed Hungarian who collapsed and died outside Parliament in December 2018.

‘Distressing accidents and dreadful diseases’: attempts to weed out fake beggars in early Victorian London

Just recently there was a news items which suggested we need to examine the hands of those asking for money on the streets of London and other British cities. Despite the fact that homelessness as risen by 170 per cent in the last eight years and food bank use has also increased the focus seems to be on weeding out the fake poor from the deserving ones.

I’m comfortable with the idea of prosecuting fraudsters  but I do wonder what sort society we have become when our reaction to someone sitting on a cold wet London street in the middle of winter is to ask ourselves ‘is he trying to con me out of 50p?’

Sadly this is nothing new. The early Victorians were just as concerned with the idea of fake beggars as we seem to be. This was a society which passed the Poor Law Amendment Act in 1834, a piece of legislation that demonized those who asked for help and attempted to discourage benefit dependency but breaking up families and locking up paupers.

It also created the Mendicity Society (or, to give it its proper names: the Society for the Suppression of Mendicity). Formed in 1818 its aim was simple – to prevent people begging in London. It tried to move beggars along and encourage them to leave the capital if possible by giving them small amounts of charity. However, it eschewed the gift of money, preferring instead to give tickets which recipients could exchange for an investigation into their circumstances. This was presumably designed to root out the scammers, who would not want to have their case considered.

Men like William Horsford worked as mendicity officers, looking out for beggars on the streets and hauling them before the magistrates. Begging was an offence under the terms of the 1824 Vagrancy act which allowed the police and others to take people off the streets for having no visible sign of maintaining themselves. This legislation is still in operation today.

In early December 1839 Horsford was on the case of two people who he knew to be incorrigible beggars. Edward Johnson (alias Watson) and Mary Carrol were known to him and the police. Mary dressed in widow’s weeds and made herself look as desperate as possible in order to attract sympathy from passers-by; Johnson was described as a ‘miserable wretch’. Horsford spotted the pair in Pall Mall and decided to tail them, calling on a police constable to help.

He followed them through St James’ Park and then to a pub in Pimlico, called the Compasses (which had existed since the 1640s at least).  They left the pub after an hour and moved on to Sloane Sqaure where they started to knock on door. At one house, where the lady resident had a reputation for charity, Mary Carrol handed over a letter to the servant that opened the door.

The servant declined to accept it, or to give them anything so they headed for Chelsea and tried their luck at a chemist’s shop.  Horsford felt he had enough ammunition now and snuck into the shop behind them. As they tried to beg money using the letter he arrested them and confiscated the letter.

The pair appeared before Mr Burrell at Queen’s Square Police court where the letter was read out. It detailed the ‘facts’ that Mary was a ‘widow afflicted with rheumatism and divers other complaints – that she had a large family, and that her husband had been killed but a few weeks ago by a gentleman’s carriage running over him’.

It was signed by a ‘Mr Churton of Ebury Street’ who recommended the reader to assist Mary ion any way they could.  When searched Johnson was found to have a number of other letters on his person, each addressed to a different but well heeled recipient (the Bishop of London, Marquis of Londonerry, and Countess of Ripon) and each of which carried their own particular ‘sob story’ of ‘distressing accidents and dreadful diseases’.

The pair were clearly poor but Johnson at least was literate. He admitted writing the letters himself but justified by stating that Mary was a deserving case and he was only trying to help. The magistrate had no sympathy (just as the vigilantes who target ‘rogue’ beggars to day have none) and he sent them to prison for three months at hard labour. At least they would be fed and housed over winter, if not very comfortably.

Beggars and vagrants were an endemic problem for the police and magistrates of nineteenth-century London. The Vagrancy Act (1824) empowered the New Police to sweep anyone begging from the streets and the Poor Law allowed for the repatriation of the unentitled back to their place of last settlement. But once arrested what could be done with ‘sturdy beggars’ like Thomas Costello? A spell in prison held little fear for them and if they had lived and worked in a town for a year at least then they could claim it was their home and be hard to get rid of.

This was the Lord Mayor’s problem as he peered down at Costello standing in the dock at Mansion House Police court in August 1837. A policeman had brought the Irishman in because he’d been upsetting sensibilities by begging ‘in a most importune style’ the court was told.

His way was to fix himself shivering and shaking against the wall, and his deplorable appearance, for he could make is very eyes almost start out of his head, soon brought customers to him’.

The officer had tried to get him to leave the city’s boundaries but Costello refused, so he took him into custody.

He wasn’t an unfamiliar sight in the police courts and the Lord Mayor was sure he recognized him. ‘We have often told you to leave the city’ he grumbled, ‘why do you persevere in annoying us?’

‘Ah, please your honour’, came the reply, ‘I’m all over pains and aches; I’m afraid I’ll never get well’.

‘You are sick with idleness’, the Lord Mayor quipped, seeing what appeared to be a strong man in the dock before him. Thomas claimed to be suffering from a bad fall from a horse, but the magistrate clearly didn’t believe him. Nor did he buy the man’s complaint that his eyesight was failing and the policeman agreed saying that:

‘there was not a beggar in the city – able and active as they were – who had better use of his eyes and hands than the defendant, who could see an officer at any distance, and get out of sight in a twinkling’.

‘Oh yes they ought to put me up as a tellygraph [sic]’ joked the prisoner, beginning to enjoy his moment in the spotlight perhaps. ‘You’d swear that I could read the newspaper from this to Portsmouth in a fog’!

Keen to determine whether Costello had been up before the bench recently (and so perhaps worthy of a more serious penalty) the Lord Mayor asked him. The beggar said he’d not been in trouble for three years which caused the police officer to comment that it couldn’t be less than six months. Guessing that he’d been in and out of gaols all over the place and that they’d proved to be no deterrent the Lord Mayor made one last effort to persuade Costello to leave London, or at least the city itself.

Oh! dear no; I won’t disgrace myself by going out of your jurisdiction’ Costello answered, no doubt with a smile, ‘I’ve got no parents, God help me, but yourself and the likes of you’.

London was his home and he wasn’t going to leave it for anyone.

And for the next couple of months he definitely wasn’t going anywhere. ‘You must have a go at the treadmill’ the justice told him.

‘I know where the mill is precious well’, Costello responded, ‘It ain’t out of the city, is it, my lord?’ And off to Bridewell he went, where he’d be fed and watered at the ratepayers’ expense but at least he wouldn’t be bothering the good citizens of London for a while.

The Beadle and the ‘burdensome’ bride

In 1834 parliament passed the infamous Poor Law Amendment Act. Historians have debated the causes and impact of this piece of legislation for decades but few would argue that it was either popular or beneficial to the poor. It established the principle that anyone seeking relief from poverty should enter the workhouse, thereby deterring all but the most desperate from applying.

Its intention was therefore partly to deter idleness and encourage thrift but also to protect the pockets of the middle class ratepayers who paid for poor relief.

The act is a long document; running to 110 clauses it would bear comparison with a modern EU directive for its complexity and attention to detail. Amongst its stipulations is this one, number 57 which reads:

And be it further enacted, That every Man who from and after the passing of this Act shall marry a Woman having a Child or Children at the Time of such Marriage, whether such Child or Children be legitimate or illegitimate, shall be liable to maintain such Child or Children as a Part of his Family, and shall be chargeable with all Relief, or the Cost Price thereof, granted to or on account of such Child or Children until such Child or Children shall respectively attain the Age of Sixteen, or until the Death of the Mother of such Child or Children ; and such Child or Children shall, for the Purposes of this Act, be deemed a Part of such Husband’s Family accordingly.

This might seem fairly uncontroversial; a man was to take on the responsibilities of looking after the children of the woman he’d married if she’d had them before he married her.

What is interesting is that is seems that poor law unions were practising a form of cost-cutting in the years before and after the new Poor Law that involved persuading local men to marry mothers whose children had fallen chargeable to the parish. Moreover, this ‘persuasion’ involved a cash incentive it seems, as this case from the Guildhall Police Court in the City shows.

An unnamed ‘young man’ came to the court to ask Sir Chapman Marshall’s advice. He explained to the alderman magistrate that he had been asked by the beadle of St Bartholomew the Great to marry a young woman who had become ‘burdensome’ to the parish.

He alleged that the parish official had promised him £5 if he married the girl and said that as soon as he produced the certificate proving the union he would get his money, a sort of parochial dowry so to speak. The beadle visited the newlyweds and pressed a paper bill into the bride’s hand, insisting that she didn’t look at it until he had left. When the note was examined the couple were disappointed to discover that it was for £2 10s, just half the amount that had been promised.

As a result the unhappy groom had approached the magistracy seeking a summons to bring the beadle to book for his dishonesty and breach of contract. The paper made a point of saying that the ‘amendments of the poor laws have not removed the incitements to bring about pauper marriages’, and clearly disapproved of the practice.

Sir Chapman presumed that the young man was the father of the child anyway, but this was refused. No, the infant’s father was dead he was told, and it ‘belonged’ (all paupers belonged in the 1800s) not to St Bart’s but to Shoreditch, which lay outside of the City. The man was obliged, as the terms of the act above set out, to support the child regardless of whether he had fathered it, and he wanted the rest of his money.

There was nothing the magistrate could do for him however, as this didn’t fall under his jurisdiction as a magistrate. He recommend instead that the man took his case before the Court of Requests, which dealt with disputes over small debts. The beadle was liable, the magistrate declared, as he’d entered into a contract and hadn’t fulfilled it. The husband thanked him and said he would certainly take his advice.

One man’s complaint reveals ‘considerable excitement’ about the trade in pauper bodies at Lambeth

In December 1857 a poor man appeared at the Lambeth Police court to ask the magistrate’s advice. In November his elderly sister was so sick with consumption (TB as we know know it) she was ordered to be admitted to the sick ward at the Newington workhouse. There, on the 3 December, she died.

Before she died she had begged her friends and family to give her a decent burial because rumours were swirling around the parish about what happened to the bodies of those that died inside the ‘house.

The next day her husband and friends presented themselves at the workhouse to collect her but she was ‘nowhere to be found’. They asked the undertaker there, and all he could tell them was she had been buried by mistake the body mistaken for that of another pauper, a Mr Bazely. Deeply unsatisfied, and understandably upset, they decided to pursue the matter with Mr Norton at Lambeth.

A local parish constable named Cook was called to give evidence of local practice. He told the court that the workhouse master ‘had been in the habit of disposing of the bodies of deceased paupers for anatomical purposes’. This had caused ‘considerable excitement’ amongst the poor of the parish’.

‘Persons who supposed they were following a deceased relative or friend to the grave not infrequently followed  perfect stranger, brought from other parishes, while that over which they supposed they were mourning had been disposed of in a  different way; and the thought of such deception created great dissatisfaction’.

Cook’s evidence was damning and must have been shocking to the reading public. Dr Elizabeth Hurren (at Leicester University) has demonstrated that there was a lively trade in the bodies of the poor in Victorian England after the the passing of the Poor Law Amendment Act in 1834. Elizabeth has also suggested that the Whitechapel murders of 1888 may well be connected to this dark history in London. The trade was exposed by a series of articles in the popular press leading, as Hurren explains, to the arrest and prosecution of Albert (or Alfred) Feist at the Old Bailey in May 1858. Feist had broken the terms of the Anatomy Act (1832) which had prohibited the sale of dead bodies for profit. That act had been the government’s reaction to the illegal trade in the dead which was exposed by the Burke and Hare murders in Edinburgh and that of the ‘Italian boy’ in London in 1831.

Feist was convicted but sentence was reserved. The case then went for review and he was subsequently acquitted. The use of pauper bodies for the training of surgeons was legal under the Anatomy Act but the practice was effetely concealed from the public and, most importantly, from the poor themselves. As Hurren’s work show:

‘Summaries of the Anatomy Act, just like the New Poor Law, were supposed to be available to the poor, pinned on walls in places they might congregate. However, in such pieces of legislation, the word “dissection” itself was often concealed behind that of “anatomical examination”.’*

The families of paupers were often unaware of what had happened or unable to do anything about it afterwards. The pressure of finding enough body parts to train all the new doctors increased after 1858 when legislation required that all medical students must study anatomy for two years. Whole bodies were now routinely cut up into their composite parts so students could practice, explore and understand.

It must have made grim reading over breakfast and supper and its interesting to see the story unfold within the reportage of the summary courts. At Lambeth Mr Norton told the complainant that the workhouse master (who was of course Mr Feist) had been guilty of a misdemeanour in allowing his sister’s body to be buried so quickly after death. He was required, by law, to keep it for 48 hours so the family could arrange a funeral themselves. He told him he was happy to issue a summons.

As we now know Alfred Feist would face trial for this and a total of 62 other instances of supplying dead pauper bodies for the anatomy trade. In the end of course he, and his accomplice in the trade – the undertaker Robert Hogg – escaped scot free. Hurren estimates that a staggering 125,000 pauper bodies were sold in the Victorian period to benefit the study of medicine.

Poor lives didn’t matter in the 1800s but the reading public didn’t really want to be reminded of that too often. The exposure of the body trade, like the scandals surrounding the treatment of paupers in the Andover workhouse in 1845-6 reminded society of the harsh realities of being poor in Victoria’s Britain in perhaps a similar way that the tragedy at Grenfell Tower has caused a considerable amount of soul searching this year. Ultimately, it seems, even today poor lives don’t matter as much as rich ones.
