‘Furious driving’ and RTAs: have we lost control of our streets?

While the Metropolitan Police courts dealt with all manner of crimes, misdemeanors, and complaints, the press only selectively reported them. Sensational cases, hard rending ones, and those which reflected a current concern were the most likely to grab the ‘headlines’ in the later 1800s.

On 12 January 1881 the Morning Post chose to focus attention on dangerous driving in central London, highlighting three cases that came before the Westminster magistrate Mr Partridge. Of course none of these involved cars or vans or motorcycles; none of the vehicles we associate with road traffic accidents had been invented in the 1880s, everything was horse drawn in Victorian capital.

Yet accidents were fairly common, and being run over by a horse drawn cart or carriage was just as likely to result in injury and death as being hit by a car today. More so perhaps, since medicine was much less effective and the emergency services much less well equipped.

Speeding was termed ‘Furious driving’ – driving or riding that endangered life – and was punishable by a fine or imprisonment; cab drivers found drunk by police could be arrested, those driving ‘furiously’ would be charged accordingly. Drunk driving was clearly as much of a problem in the 1800s as it was in the 1900s.

On 11 January John Smith was charged before Mr Partridge at Westminster with being drunk in charge of his hansom cab and running over a little girl. Smith had been driving along the Fulham Road and turned quickly (too quickly really) into Marlborough Road, just as Rhoda Thompson was crossing it.

Smith’s cab hit the child who went under the wheels and was run over. A policeman saw the incident and intervened, making sure Rhoda was taken to St George’s Hospital. The cab driver appeared to be drunk and so he was escorted to the nearest police station to be charged. In court Smith said he was distressed by the accident but not drunk and said the officer must have mistaken his shock for inebriation.  The magistrate was told that the girl was still in hospital and her condition not yet known, with that in mind he remanded Smith in custody to see what happened.

Next up before him were George Franklin (21), James Galleymore (also 21) and Fredrick Drake (a labourer, whose age was not given). Franklin and Galleymore were carmen, the nineteenth-century equivalent of van delivery drivers today. Franklin had been arrested for being drunk in charge of a horse and cart and knocking down John Silcock in the King’s Road, Chelsea. Galleymore and Drake were both drunk and disorder the court was told and the former was also charged with assaulting PC Campion (506T) at Chelsea Police station.

Franklin was driving a van ‘rapidly’ as it went round the corner by the police station, just as Silcock was crossing the road. Silcock, an elderly man who was employed as a timekeeper by the London Omnibus Company, was knocked down but, fortunately, not badly hurt. He’d been carrying a small child in his arms and miraculously, she was also unharmed.

Mr Partridge, perhaps minded to make an example of the trio, said ‘he was determined to do all in his power to put down this reckless driving in the streets’. He sentenced Franklin to two months in prison with hard labour, gave Galleymore six weeks, and fined Drake 10s for being drunk (warning him he’d also go to gaol if he failed to pay).

Finally, John Lincoln was brought up to face a charge of being drunk in charge of his Hackney cab. On Monday evening Lincoln’s cab had collided with a ‘light spring van’ being driven by William Dyerson on the Vauxhall Bridge Road. Such was the force of the crash that Mrs Dyerson was thrown out of the van onto the street, breaking her arm.

A policeman saw the whole incident unfold and rushed to help the lady. Lincoln was arrested and the officer declared he was drunk and driving ‘recklessly’. Mr Partridge decided the incident was severe enough to require a jury trial and committed him to the next sessions of the peace.

Lincoln (who gave his age as 52) appeared at the quarter sessions on 24 January 1881 where he was found not guilty of furious driving but was convicted of willful misconduct, and of causing ‘bodily harm’ to Jane Dyerson. The court fined him 20s.

In the streets around me a 20mph speed limit is in place, because there are several schools near by. This doesn’t stop people driving ‘furiously’ and on the main road cars and vans frequently race across the zebra crossing, even when pedestrians are halfway across it.  They know that they are very unlikely to be caught or prosecuted for doing so, and so can speed and endanger lives with impunity.

I’ve raised it with the council who aren’t interested. I’ve raised it with the police who were too busy to even respond to me. It seems that unless someone dies we don’t road traffic incidents as seriously as Mr Partridge once did.

Class wars in Hampstead as a dog gets amongst the model boats

Mr Horace Lister was a member of the respectable middle class. He lived in Kilburn with his wife and family, and practiced as a barrister. On Sundays he enjoyed nothing more than taking his kids up to Hampstead Heath so they could sail their model boats on Whitestone Pond.

On the 29 April 1893 Lister was up at the pond with his children enjoying the spring sunshine and joining in with all their other families floating their yachts and other craft. I can picture the scene because in the 1970s I can remember my father taking myself and my brother to watch the boats and walk on the heath.

It was there he told me tales of Dick Turpin and his famous ride to York, and how the notorious highwayman had shot at his pursuers, leaving holes in the walls of the nearby Spaniard’s Inn. It was a tall tale, but I didn’t discover this till much later.  Perhaps Mr Lister was equally inventive, or shocked his children with stories from the courts he attended. I doubt he expected to feature in one that day.

As he watched his children play he saw a dog launch itself into the water and chase the boats. The animal was ‘fetching’ the boats “without being asked to do so” (as he later observed). When it grabbed hold of his daughter’s with its teeth Lister shouted at it to drop it. He had already noted who owned the dog and so he called across to him to keep better control of his beast.

His attempts to make the dog drop his child’s toy were as ineffectual as his attempt to get the animal’s owner to intervene so he decided to take the law into his own hands.

Taking his umbrella he struck the poor dog several times across its neck and back, to force it to dislodge the boat. Seeing this, the animal’s owner rushed over and caught hold of the barrister by the arm. Arthur Smith was a coachman and strongly built, and he remonstrated with his dog’s attacker. Smith threatened to ‘duck’ him in the pond if he didn’t leave his pet alone.

There were several witnesses to the skirmish and at least one, a gentleman horse rider who was passing by and saw the whole episode, was happy to corroborate Lister’s version of events when the case came before the justices at Hampstead Police Court. Mr. O’Connor, the equestrian, said he was worried that the rougher man was about to throw his victim right into the water. Lister’s ten year-old son also testified to the veracity of his father’s story, as we might expect him to.

As for Arthur Smith, well he was outnumbered and quite literally, outclassed. As a member of the working class, and not a very well respected one at that (coachmen and cab drivers had a reputation for being ill-mannered and surly) he was never going to win this battle. He claimed his dog had only gone into the water the once, and that he’d ‘called it out immediately’. He described the attack as unnecessarily violent and the charge as ‘wicked’; his dog was valuable and it had been badly hurt he added.

Not surprisingly the bench sided with the barrister and fined Smith 10or seven days imprisonment if he couldn’t pay. He paid up and left, and hopefully chose a different route to walk his dog in the future.

Plenty of sympathy but no justice for a Hackney cab driver

This case shows how statute law sometimes clashed with popular perceptions of how justice should work, even when the supposed ‘keeper’ of the law (the magistrate) felt that the law was wrong, or at least not fit for purpose.

William Loakes was a cab driver from Rotherhithe and this was his third appearance before the Southwark Police Court magistrate. Cabbies didn’t have a very good reputation in the 1800s, being described as surly and disrespectful, especially towards wealthier clients. They were not infrequently accused of overcharging or refusing to take fares where they requested to go.

But Loakes had done nothing wrong and had been coming to court to seek redress. He claimed he was owed 10s by a man named Thomas who had given his address asBor the Nag’s Head pub in Borough. He had come twice before to get a summons against the man but so far he had failed to trace him. No one  at the pub had any knowledge of him so William was back in court to ask for a warrant to arrest him.

The Warrant officer of the court told the magistrate that two summons had been served at the address but since ‘Mr Thomas’ (if that was his name) was not there they’d had to return with them. Mr Bridge was apologetic but explained that he didn’t have the power to issue a general warrant to arrest the fare dodger since that wasn’t a crime under the terms of the Hackney Carriage Act. The act, passed in 1853, set out plenty of regulations for the operators of cabs but failed (in Mr Bridge’s view) to protect the drivers from non-payment by their customers.

‘Cabmen were liable to severe penalties if they broke their contracts, and the parties that hired them should be treated the same way’, said Mr Bridge. He added – using the fact that his words would be reported – that he thought it high time Parliament looked at the law and changed it according to give magistrates more powers to deal with this.

There was little he could do for Mr Loakes however, who had already lost three days work sitting around in Police Courts trying to get his 10s. He suggested the matter be communicated to the Commissioner of Police in the hopes he might use his influence to get the law changed. Finally, he granted the cabbie a third summons for free and Mr Loakes left court after thanking the magistrates ‘for his kindness’ (but probably grumbling under his breath about the unfairness of it all – he was a London cabbie after all).

A brutal husband is saved by his terrified wife

This week my masters students at the University of Northampton will be looking at the subject of domestic violence. This 14 week module concentrates on Violence and the Law and we discuss all forms of violence (including state violence inflicted as punishment). Historians and criminologists have shown that, in history, the vast majority of all violent crime (homicide, assault, wounding, and robbery) was committed by men.

It is also true that the most likely relationship between murderer and victim was domestic or at least involved parties that were known to each other. Despite the concentration of ‘true crime’ histories and television dramas on ‘stranger’ murders, the reality was (and is) that most people know the people that injure or kill them.

Many of the domestic murders that were eventually prosecuted at the Old Bailey in the nineteenth century started their journey in the summary courts. Moreover, these courts heard countless incidents of male violence towards their wives and partners, some of which may well have been steps on the way to a later homicide. Working-class women in the victorian period put up with a considerable amount of abuse before they went to law since the consequences of involving the police or magistracy could make a bad situation worse.

Several of the  Police Magistrates who wrote about their careers expressed their frustration at the abused wives who continually summoned their spouses for their violence only to forgive them or plead for leniency when they appeared in court. This is one such example of the almost impossible situation some married found themselves in in the 1800s.

William Collins was described as a ‘powerful and ruffianly-looking fellow’ when he stood in the dock at Lambeth before Mr Norton. His wife, Elizabeth, was unable to appear at first, so injured was she by her husband’s violence. In her place the constable dealing with the case told the magistrate what had happened.

He explained that he was called to a house in Caroline Place, Walworth Road where the couple lived. He found Elizabeth ‘in her night dress, with two or three deep wounds on her arms and one on her chest, from each of which the blood was streaming’.

Collins had apparently attacked his wife with a broken wine bottle, ripping her flesh with the jagged edges of the glass. The PC arrested Collins and put Elizabeth in a cab so she could be taken to hospital to have her wounds dressed. The court heard from the surgeon that treated her that she was ‘within a hair’s breath’ of dying from her wounds; fortunately for her the cuts had avoided any major organs.

The constable reported that when he had gone to fetch Mrs Collins to appear he was unable to find her and believed she was unlikely to press the case against her husband. Mr Norton chose to remand Collins in custody until Elizabeth could be found and encouraged to appear.

A few hours later she did come to court, but was clearly (the paper reported) ‘under great terror of the prisoner’. To no one’s surprise despite the horrific attack Collins had inflicted on her she ‘used every possible effort to get her husband off’. The magistrate was hamstring by her reaction and did as much as he could to help her by bailing Collins to appear ‘on a future day’.

He was presumably hoping that this brush with the law would serve as  session to the man, effectively warning him that if he hurt Elizabeth again in the meantime he would face the full force of the law. Sadly, I doubt this would have had much, if any affect on someone who was prepared to slash his wife with such casual cruelty.

The showman, the tram conductor, and the irritated magistrate.

Fare dodging was frequently punished at the summary courts. Conductors of trams or buses, hackney coachmen, and train guards brought in travellers  who had refused or neglected to pay for their journeys. In some circumstance this was because they disputed the amount charged (most often when it came to cabs) or claimed that they hadn’t realised the vehicle was going as far as it was, or had missed their stop. It seems that in most of the instances that were reported by the press the customer paid up, often with an added penalty of paying the transport company’s court costs.

Harry Perkins was one such example of a fare dodger that annoyed the sitting magistrate  at Thames and ended up paying much more than he need have had he simply bought a ticket in the usual way.

Perkins was described as a ‘showman, living in a caravan at Dalston’. So perhaps he was a part of a travelling circus. His actions in late October 1890 certainly entertained the editor of The Standard who decided to submit his story to print for his readership. The circus man boarded a tram in Dalston and travelled to Shoreditch where he attempted to get off. At this point the conductor (‘Conway, badge 1227’) asked him for 1s for his fare. When this was refused Conway restrained his customer until a policeman was found who could take him into custody.

In court the next day Perkins was charged with refusing to pay his fare and with being drunk. The magistrate started by questioning the tram’s conductor as to Perkins’ conduct.

Was the prisoner drunk, Mr Williams asked Conway.

‘Well that depends’, came the reply.

‘What?’ said the justice.

‘It is a very difficult thing to say whether a man is drunk or not’, was Conway’s response.  ‘Some people say that a man is not drunk when he can stand; others say that…’

At this point the magistrate cut him off.

‘I don’t want a lecture on drunkenness’ he grumbled, ‘if you can’t prove that the man was drunk on your care there is an end of that part of the charge. How about refusing the fare?’

Once a sheepish Conway had muttered that yes, he had refused the shilling demanded Mr Williams turned his attention (and clear irrigation) to the showman in the dock. Why had he attempted to get off without paying he wanted to know.

‘I did not want to ride’, answered Perkins. ‘I got on the car, and found the seats on top wet, and the inside was full, so that I wanted to get off, and the conductor would not let me’.

‘But you had a good long ride’ declared Mr Williams, adding ‘so it took you about half-an-hour to find out that the seat was wet?’

The prisoner could only restate his previous explanation that he ‘did not want to ride’. The magistrate dismissed this with a curt statement that he was fining him 10for the trouble he had caused when all this could have been avoided had he simply paid, when asked, the 1s fare.

I rather suspect that the message Mr Williams was sending was intended for a wider audience than the circus man. His time had been wasted unnecessarily and he wanted to avoid similar cases coming before him in the future. It probably also served as a rebuke for the conductor (and therefore all bus and tram conductors) and allowed readers to chuckle over the discomfort of ‘jobsworths’ everywhere.

A sorry pond dipper is saved by the local bobby

Police constable Milne (163P) was walking his beat close to Dulwich College, south of the River Thames when he heard a noise. It was about 10.30 at night and so he clearly wasn’t expecting to here sound near the school and set off to investigate. The sound seemed to have come from close to a pond near the college and to his horror PC Milne now saw a pair of feet and ankles sticking up from the water.

Removing his helmet and stripping to the waist the policeman dived into the pond and made his way towards the feet. ‘With difficulty he managed to reach the place where he had noticed the feet’ [they had since disappeared beneath the water], and was then able to drag the person out and on to the bank. The pond, he observed, was about nine feet deep.

Using the first aid he had been taught as a police trainee he revived the man he had rescued but he was far from grateful. As soon as he came to the bedraggled pond dipper ‘made a rush for the water’. Constable Milne secured him and conveyed him back to the nearest police station.

At the station the prisoner revealed that he was ‘a hackney carriage proprietor’ named Mitchell who lived in Lower Norwood. He admitted that he had been trying to kill himself and was promptly charged with the same. At Lambeth Police Court he again confessed his fault and said that he hoped the magistrate, Me Ellison, would send him to prison for a year as it was all he deserved. Instead Ellison remanded him in custody so that enquiries could be made as to his mental health.

He commented PC Milne for his quick thinking and his bravery and said he deserved a reward. Hopefully Mr Mitchell recovered and perhaps recognised that the copper had saved his life, and maybe even rewarded him himself. At least for PC Milne he had a story to dine out on for the rest of his career.
