‘There’s no justice for a ticket-of-leave man’: Fenians, Police and the ‘Manchester Outrage’.

In the 1850s transportation to Australia slowly declined before being abandoned in the 1860s. Transportation, which had been the most effective alternative to hanging for the Georgians, was now itself replaced by incarceration at home. In 1865 the Prisons Act consolidated control of prisons under a government agency (rather than being left to local control) and penal servitude replaced transportation as the most serious of non-capital punishments.

One of the innovations of the colonial transportation system had been the mark system. This allowed convicts to earn points for good behaviour; points that might lead to better conditions, food and, ultimately, early release. The principle was sound: convicts would be easier to control if they understood that it was in their interest to get their heads down, accept their punishment and strive to win their freedom. The ultimate goal was a ticket-of-leave, which allowed convicts to live as free men within the colony, so long as they did not offend again.

The ticket-of-leave system (which in modern terms is parole) was exported back to England and applied to criminals locked up in the country’s various gaols. Here too offenders could earn the points that would enable them to be released on license before the end of their sentences. There were conditions of course, and these were easily broken, at which point a convict might find himself up before a magistrate and, ultimately, back in prison.

In May 1867 John Jones had been released on a ticket-of-leave and came back to his friends and family in London. The license required that he report to the police with 48 hours of being released and that he carried his ticket-of-leave on him at all times. Moreover, every moth Jones was required to report in to his nearest police station and confirm his address. He was then expected always to sleep at this address, and no other. The police were supposed to able to find him if they needed to. If he moved home Jones had 48 hours to inform the local police or he would be in breech of the terms of his release.

This close relationship with the local police must have made it pretty difficult for a convicted criminal to return to normal life. The prison stamp would have been on Jones following his release: the deathly pallor, close cropped hair, poor constitution, and sunken eyes (all products of the ‘hard labour, hard bed, hard fare’ policies of the prison system under Edmund Du Cane) would have marked him out as an ex-con. With little opportunity to rejoin ‘straight’ society Jones would naturally have gravitated back to the ‘criminal class’ that Mayhew and Binney had described in their writings.

In late November 1867 PC Harry Shaw (77G) saw Jones in Golden Lane, Clerkenwell. Jones was with a group of men the officer knew to be convicted thieves and he understood that he had gone there to express his sympathy ‘with the relatives of three men who had been hanged at Manchester on the previous day’.

This was a infamous case, that of the ‘Manchester Martyrs’. William Philip Allen, Michael Larkin and Michael O’Brian were Fenians, members of the Irish Republican Brotherhood, and they had been part of crowd of over 30 who had attacked a police van carrying fellow Fenians to gaol. In the attempt to release their prisoners a policeman, Sergeant Charles Brett, was killed.

Five men were convicted of Brett’s murder but two had their sentences overturned. Allen, Larkein and O’Brian were not so fortunate and were ‘turned off’ in front of a huge crowd above Salford Gaol on 23 November 1867. This was one of the very last public hangings to take place in England. Karl Marx remarked that the hangings served the cause of Irish nationalism better than many an act of terrorism had because it gave them martyrs to act as inspiration for the next generation of freedom fighters.

Naturally anyone celebrating those that had killed a police officer was unlikely to earn much sympathy from a serving constable. John Jones had joined a procession of men and women who marched from Clerkenwell Green to Hyde Park and PC Shaw followed, watching them. As they ‘dodged’ in and out of the crowd the constable suspected they were trying to pick pockets but he had no definite proof, just suspicion.  In the end he collared Jones and cautioned him, demanding to see his ticket-of-leave. Since he didn’t have it on him, Jones was told he must appear at Clerkenwell Police court to explain himself.

In early December, looking ‘rough’ John Jones presented himself before the sitting justice. He said little, saying ‘it was no use for him to speak, as there was no justice for a ticket-of-leave man’. The police, added, ‘had entered into a conspiracy to injure him, and he could do nothing’. The magistrate asked to see his license but he didn’t have it on him so he was remanded in custody so that one of his friends could fetch it.

Within days Clerkenwell itself experienced the full force of Fenian terror as conspirators attempted to break their fellow nationalists out of prison by blowing open the gate.  On 13 December 12 people were killed and over a hundred were injured in what The Timesdescribed as ‘a crime of unexampled atrocity’. Eight men were charged but two gave Queen’s evidence against the others. Two more were acquitted by the Grand jury and , in the end, only Michael Barrett was held responsible for the bomb. On the 26 May 1868 Barrett earned the dubious honour of being the last man to be publicly hanged in England as William Calcraft ‘dropped’ him outside Newgate Gaol.

A boot and shoe fraud exposed by the fear of terrorism

While I was born and live in London I teach history at the University of Northampton, so I’m always on the lookout for stories which link the capital to the east Midlands. Not surprisingly – well at least not surprisingly to someone that knows Northampton’s history – this case from Westminster concerns the boot and show trade, for which Northampton was (and remains) mostly famous.

Three people appeared in the dock at Westminster Police court on the 15 May 1883, two women and a man. They were charged with ‘unlawfully conspiring with other persons to obtain goods … by false and fraudulent representations’.  The ‘goods’ in question was a quantity of leather and boots and the trio were apprehended as the result of a targeted police investigation into fraud.

Detective sergeant Arthur Standing was on watch outside the Life Guards barracks in Knightsbridge (which had recently been the subject of a bomb threat) watching a house opposite.  The house was rented in the name of Edmund O’Connor, a commercial traveller in the boot trade. His Irish surname may also have raised suspicions given the proximity of the barracks and the spectre of the ‘dynamitards’.

Between 8 and 9 at night DS Standing and another officer waited as two women approached the house, each carrying a large bundle. Standing stopped the women and searched their bags. These were found to contain leather, which was later traced to wholesalers in Northampton and Leicester. Both women – Mary O’Connor and her daughter Elizabeth were arrested and Edmund followed soon afterwards.

The magistrate, Mr St John Poynter, was told by the police that they were investigating a number of other thefts connected with this case and asked for the three prisoners to be remanded. Poynter complied with their request and committed them to trial at Old Bailey and sent them back into custody in the meantime.

When it came to trial a couple of weeks later it became clear that Mary was the mother of the two other defendants, not Edmund’s (or indeed Edward as the Old Bailey court recorded his name) wife. Edward was the principal here and the goods stolen were in fact a large number of boots. O’Connor had apparently been trying to establish a boot and shoe shop on Knightsbridge High Street   and had obtained the lease to rent the premises from a solicitors in Jermyn Street at £120 a year. However, when he didn’t pay the money as agreed the solicitor’s cashier went looking for him in Knightsbridge, finding only his mother who said he was travelling on business.

Meanwhile O’Connor had been busy ordering samples under the name of ‘Andrews’ and placing an order with a manufacturer in Bethnal Green.  A succession of creditors and unhappy traders gave evidence and Matthew O’Brien of CID reported that he’d entered the premises (searching for the elusive explosives they’d been tipped off about) and found it empty, dirty and with ‘no sign of business’. This must have rung alarm bells and prompted him to alert DS Standing.

In the end it was a complex case in which it seems that O’Connor was possibly trying to set up a legitimate business in town based on his wider contacts but was short of ready cash. That’s the generous explanation of course. He may well have been conducting a sort of ‘long firm’ scam where he pretended to be a genuine businessman in order gain credit and goods before clearing out before he paid a penny for anything he’d obtained.

That was what the jury thought although the element of doubt possibly worked in his favour as he only received a twelve-month prison sentence. His mother and sister fared better; found guilty of conspiracy by recommended to mercy by the jurors they were sent down for two months’ each.

The name ‘O’Connor’ would have chimed with the secret services of the day; a James O’Connor had been a prominent member of Clan na Gael who had been arrested in 1881. Special Branch was formed later in 1883 to combat Fenian terror and anyone with an Irish name would have aroused suspicion that close to a military target. In October 1883 Clan na Gael planted a bomb on a District Line underground train heading for Gloucester Road station. Thankfully no one was hurt and little damage was done but more attacks on the network followed.

We forget that London was targeted by terrorism in the 1880s but this case, of a fairly mundane if ambitious fraud, reminds us that the capital’s police (like their colleagues today) had to fight and political violence at one and the same time, with limited resources.  Who knows, if O’Connor’s name really had been ‘Andrews’ he may not have aroused suspicion and his gamble might have paid off.

A ‘suspicious person’ at Woolwich, but ‘not clever enough’ to be a terrorist.

In the 1880s Woolwich was home to the Royal Arsenal, as it had been since the 17th century (and in fact earlier as there had been used for gun storage from the mid 1500s). After 1886 it was also home to what was to become one of London’s most successful football clubs, Arsenal FC.

Given that artillery and shells were manufactured at Woolwich in the 1800s the site was an important one for the Victorian military, but also a target for the enemies of the state. Security, then, as now, was an issue of national importance and the Victorian state was concerned about internal threats just as much as it was about  those posed by rival imperial powers.

In the 1880s there were  a series of terrorist incidents in London, all part of a long running campaign by Irish nationalists in the cause of independence. It is a subject I have looked at as part of my research into late Victorian London and I drew heavily on the capital’s newspapers and the work of K. M. Short, whose study of Fenian terrorism remains the most comprehensive one out there, despite its age.

So, given the background, we might expect the authorities at Woolwich to be on the look out for potential terrorists, and in April 1881 they thought they might have caught one.

Two constables from the Arsenal were patrolling by the river front when they saw a man rowing up and down, seemingly watching the shoreline. It was particularly suspicious because this was at just after one o’clock int he morning and they could not see what legitimate purpose he had for being there so late (or early). At three he was still there so they called to him and asked him what he was about.

He replied that he was lost and was it possible for him to land. The constables directed him to a pier, and when he docked and climbed the steps they arrested him. The police were called and they questioned him. It was soon discovered that the boat he was in had been stolen from an MP who lived at North Woolwich, Mr (later Sir) Thomas Brassey the member for Hastings.

The man’s name was Michael Sullivan and his peculiar behaviour and Irish background raised concerns that he was a Fenian bent on mischief at the Arsenal. However, when Inspector McElligot was called to give evidence he ‘repudiated any supposition that Fenianism had anything to do with the case, and complained that the most extravagant and unfounded rumours had been circulated’.

The magistrate agreed, he commented: ‘I agree with you that he is not a Fenian. I doesn’t look clever enough’, which was met with much laughter in the Woolwich Police Court, before his worship (Mr Balgey) sent him to prison for a for a month at hard labour.

1884 saw a number of terrorist outrages in London. A bomb was placed at Victoria Railway Station and other London termini, and a fairly inept attempt to blow up London Bridge resulted in the death of the bombers. In May 1884 two boys kicking an abandoned briefcase attracted the attention of a policeman who found they were playing with a case containing dynamite, fuses and a detonator! These incidents followed attacks in 1882 (at the Lord Mayor’s residence, Mansion House) and at the offices of The Times newspaper in 1883. In January 1885 the Houses of Parliament were targeted  along with he Tower of London, and the new underground railway was also subject to a bomb attack, as the Hammersmith train left Aldgate station.

There were few deaths and nothing like the serious level of injury that modern terrorists have inflicted recently, but it still reminded Victorian society that as long as Britain insisted on claiming Ireland as a colony Victoria’s subjects would not be safe in their homes or their streets. It also contributed to wider prejudice and the stereotyping of Irish immigrants in London and elsewhere, something that we see repeated in the demonisation of moslems today.
